Glad to hear you are safe and Naples was not hit to hard. I heard the eye came in just South of Sarasota (Siesta Key area). I am not sure if my brother and SIL plan to head back down from Atl. as I haven't talked to him yet, but I assume the power situation there is a bit shaky. Their house is right off 41 just South of Venice, so not right on the coast, but not too far away. Last time the storm hit Ft. Myers, they only lost their lanai screen and one tree, hope it is not too bad for them this time as well, but they were on the higher surge side this time.

Sounds like the aunt would be the joint sponsor for I assume her brother. That is perfectly legal, so both your friend and the aunt will need to fill out I864s for the father/brother. This is fairly common, the aunt could also file an I130 for her brother, but that will take 20-25 years, however your friend's I130 will be much faster, and there is no law saying that the intending immigrant has to live with the primary sponsor of the I130.

DCF in Auckland
Dashinka replied to Epmusky's topic in Direct Consular Filing (DCF) General Discussion
I assume when you say partner you mean legally married. I haven’t heard many stories of DCF from Auckland, but here is a thread that may be helpful as to the generic process steps to attempt DCF with exceptional circumstances. I also posted the contact information for the U.S. consulates in NZ. I would start with the email address for the Auckland consulate. You as the USC requesting the consulate take on the I130 can use this email. Also, I assume you have not already filed an I130, and also that your child already has a U.S. Passport. Good Luck! https://nz.usembassy.gov/contact/#embassywellington -
Stepkids USC
Dashinka replied to csh2020's topic in Bringing Family Members of US Citizens to America
Spousal visas or other Immediate Relative visas do not allow for derivatives. As @JeanneAdil stated, each step-child will need a separate petition assuming the step relationship was created prior to the child's 18th birthday. -
She can try, but it will be a hard bar to overcome immigration intent with an I130 in process. A denial should not impact the spousal visa case unless she would materially misrepresent herself with a B2 interview or on the DS160. Good Luck!

If they need additional information, or to do other work such as background checks, you could get a 221g and the color of that paper is meaningful. If the CO does not give you a 221g, then all you might get is a verbal approval, but even that is not final. What you need to look for is "Issued" in the online system. As to how long it takes to get the passport back with a visa, that is highly variable depending on the case and the consulate. Anywhere from a week or two to over a month or more. Good Luck!

Daily Update on Kamala Tanking America

Yes, Democrats are definitely no friend of Democracy, or at least any Democracy that might cause them to lose power. -
I-130 with previous I-129F/K1
Dashinka replied to Maitremathieu's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
The K1 visa was used for an entry, so nothing needs to be done (K1 is single-entry, so when CBP endorsed it, the visa becomes invalidated for any other potential entry). You should be fine with moving to a spousal visa, don't worry about the previous K1. Good Luck! -
Daily Update on Kamala Tanking America
Dashinka replied to Boiler's topic in Current Events and Hot Social Topics
Going to put this here as KK admitted, her and Biden were one and the same at least policywise. When Is Blowing Up the World A Success? Did Biden’s 2019 campaign assurance that China was not in competition with the U.S. detour China from its subsequent combative stance toward Taiwan? Did giving millions to the Palestinian Authority, Hamas, and Hezbollah persuade them not to send some 20,000 rockets and missiles into Israel after October 7? Will giving Lebanon some $157 million in “extra” aid persuade the population to turn on Hezbollah that has stored some 150,000 rockets and missiles aimed at Israel in their midst? Did prior aid result in only 9,000 missiles being launched from Lebanon at Israel? Did the DEI mandates and advertising, the new woke protocols, and the vaccine expulsions all explain why the Pentagon was only 45,000 short in its targeted manpower recruitments? So please, Secretary Blinken, President Biden, a Vice President Harris, and candidate Walz, do not in the last weeks of the election gaslight us, the American people, that a world now in freefall and on the threshold of multiple theater-wide wars, all involving nuclear powers, is somehow a sign of a “stronger geopolitical position.” -
Bulky I-751 Application

We just used a big binder clip although it wasn't nearly that much paper (3in is more than a full pack of printer paper). -
Harder to get approved after denial? (Merged threads)
Dashinka replied to Milou82's topic in Work Visas
If you read the threads I posted, sometimes the presentation can make all the difference with an O1. I believe @mindthegap is fairly familiar with O1's, maybe they will weigh in. -
Yes, I was amazed when we hiked to Darwin Falls during our visit.

Are Hurricanes Getting Worse? That “climate change” — undefined and usually unquantified — is making weather patterns more adverse is a given among the chattering classes, but it always is useful to examine the actual underlying data. A prominent example appeared in a recent column in The Hill, in which reporter Rachel Frazin argues that “Climate change is making hurricanes like Hurricane Helene more intense, scientific research shows.” Frazin notes as well that: “The proportion of hurricanes that fall into these more intense categories 4 and 5 are expected to increase as the planet heats up, according to the most recent report from the Intergovernmental Panel on Climate Change…” “Peak hurricane wind speeds are also expected to rise.” https://www.realclearenergy.org/articles/2024/10/07/are_hurricanes_getting_worse_1063500.html

Harder to get approved after denial? (Merged threads)
Dashinka replied to Milou82's topic in Work Visas
DIY O1's are quite rare here on VJ. Just a quick search only turned up a couple of examples the most recent being from 2019 (see below). The best advice is to look for a good immigration lawyer that specializes in O visas as much of the success depends on the way the evidence is packaged. Good Luck! -
Are you sure? Who would be the fallback? Hillary? Btw, I think the horse has left the barn, regardless of the number of states with a Democrat SoS, there is no way the DNC could put another new candidate on the ballot. In general, I would assume the bonafides of Kamala would have been checked in 2020 relative to being VeeP or President, hard to say though, as all those folks in DC think they are smarter than anyone else, and honestly, the elite political leaders and MSM cannot be trusted.

Is the oldest child married, or moving toward marriage? As @pushbrk stated, your USC petitioner (spouse? sibling?, parent?) assuming a spouse cannot petition the oldest child as the marriage occurred after they turned 18. The other three children require separate petitions (I130s) and supporting evidence to actually get a visa. When you get your visa (I am assuming a marriage based visa) and enter the US as an LPR (green card holder), you can petition for the oldest child if they are not married. If they are married, or marry even after your petition, they will not be eligible for an F2B visa, and you would need to submit a new petition after you naturalize as an F3 visa which will take 15-20 years. The good news is as a Canadian citizen (I am assuming this), the oldest child can visit.
