Since you entered on a K1, but married someone different than your original I129F petitioner, you did not have the option to AOS through someone else inside the U.S. Since you had an approved I601 waiver, and pursued consular processing, you should be fine. My priority was to help her adjust to moving halfway around the world, making sure she had a phone to communicate with our family, introducing her to friends that became mutual friends, and doing everything I could to help her out.

I forgot to mention Mammoth Cave, and Great Smoky Mountains NPs. We really liked both, but Great Smoky Mountains was an absolute zoo, but did have some nice trails. Mammoth Cave was also great, loved the little river ferry and the trails on the other side of the river were great. I also think I forgot New River Gorge in WV. Amazing trails.

Sort of like the DoS by law assumes anyone applying for a NIV has immigration intent, let the IO assume anyone AOSing from a B2 et. al., have preconceived a plan to do this when entering the U.S. during an AOS interview. The beneficiary, then has the burden of proof to show there was no pre-planning. So sort of like a second entry inspection if the decision is made to AOS on a NIV.

That is really an interesting take. I must admit when I first joined VJ, I had fairly strong feelings about AOS from B2/ESTA et. al., but those have changed over time. I know, it allows people to jump the line, and more than likely 80% or more of the couples or people (other IRs) doing it probably decided to do it before entering the US, but there are times when it is really necessary. My thought is that Congress needs to change the law to allow an AOS interview to also include another entry interview and the beneficiary (and petitioner) has to prove there was no pre-planning to this.

I have mixed feelings about this case as it appears the subject actually did succeed on her own eventually. So yes, apparently early in her schooling she was promoted even lacking reading and writing skills, but that changed eventually. As to the lawsuit, if she is only doing it to bring awareness I am fine with that, but if she is doing it for her own personal payday, then I think less of it. Sure the school failed her early on, but she also learned she could do it on her own and didn't need a handout.

Detroit is actually a very comfortable PoE. The international arrivals area is not too busy, and the airport generally gets your luggage to you relatively quickly. I remember when my wife (at that time fiancé) arrived on her K1, it took only maybe 15-20 minutes for her to get through CBP at Detroit.
