If you want to go there, look at the history of the presidency in the ROK. Many of the past presidents in that country have ended up in jail mostly due to corruption. In the US, we celebrate political corruption and create a two tier justice system so the important people or the people of a certain political ideology are taken care of. If the husband still has valid residency in the country, I don't see any reason why they cannot attempt DCF even if he is physically back in the US setting up a residency. Like I mentioned earlier, maybe he can work something out with his manager to go back for a month or two.

No, if your husband submits an I130 (online or by mail) to USCIS, DCF is no longer an option. You have to put the request in at the consulate first.

DCF stands for direct consular filing. It used to be more common when USCIS offices were more widespread around the world, but now they are only allowed at the US consulate under exceptional circumstances. One of the common exceptions is when a USC spouse has to repatriate due to work responsibilities. What happens is the USC contacts the consulate and request they accept the I130 filing for an eventual spousal visa along with the reasons (I.e short-term job relocation back to the US). If the consulate accepts it, the processing time for the I130 and visa is accelerated greatly (usually less than six months or so). I am not sure this is an option anymore since your husband already went back to the US, but it may be if he can work something out with his manager and he still has valid residency in the country you are at. That would be an interesting plan. Maybe the husband could work something out with his manager to temporarily head back overseas to potentially do the DCF.
