Document for interview appointment
Dashinka replied to Yoshie's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
If the name was changed through naturalization, then that certificate functions as the proof of that name change. Good Luck! -
Staunch belief? Did the CA legislation and CA Governor by the name of Newsom propose, pass, and sign in a law that requires gender neutral toy aisle(s)? Not really sure about your personal issues/beliefs, that is your own burden, but open minds can be beneficial instead of simply relying on Democrat talking points/narratives.

Heard a top of the hour news report on the radio (CBS I think) where they described the MI SC of punting this case. They did no such thing, they simply found that the lower court came to a correct decision, and there was no need for further litigation. Also keep in mind that the MI SC is now a majority Democrat. I agree, this really makes the CO SC look like a bunch of partisan hacks.

You are ignoring section 5 of the 14th Amendment, the Democrat political operative Sidney B. (Who quite possibly lied under oath) glosses over it, but it deserves more analysis. What law has Congress passed with respect to Section 3 that would disqualify Trump? 18 US Code Section 2383 is the only one I know of, but the CO SC relied almost solely on the partisan output from Nancy Pelosi’s January 6th Committee (not a court of law, and no due process was followed) in their findings. Donald Trump has never been charged with insurrection under the law above even with the partisan prosecutor Jack Smith throwing everything against the wall. Additionally, the fact that other state SCs are seeing it differently that’s CO makes their case weak. We shall see what happens of course, but quite honestly I would put more faith in the analysis of a legal scholar like Turley (also a Democrat btw.), than a Democrat political operative, with very close ties to the Clinton family (we know what they are capable of manufacturing politically), like Blementhal. Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article. https://en.wikipedia.org/wiki/Fourteenth_Amendment_to_the_United_States_Constitution#Section_5:_Power_of_enforcement

Do you plan to move into your wife’s parent’s house when you get the visa, or are you planning on leasing an apartment or buying a house? -
Here is what the Leftist Hero Newsom is doing to CA. Btw, love the spin as the Democrats are still scrambling for a solution to Old Corrupt Petulant Joe. It is interesting how Newsom complains that DeSantis was playing politics, seems Newsom is also doing the same thing. https://www.foxnews.com/politics/california-fine-stores-dont-have-gender-neutral-kids-toy-section-2024

The general rule of thumb is double the amount of time outside the U.S. than inside, but there is no hard and fast rule. Some people abuse a B1/ESTA, come for the maximum stay, leave, and come back a short time later expecting another lengthy stay. Those are usually spouses, or fiancées, but I suspect other family members as well. You mentioned they would come for only a couple of weeks at a time, that should be fine as long as they are not coming many times in the same year period.

how to handle RFE
Dashinka replied to salman_shah's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
Ok, so NVC is not DQ’ing the case without additional information. Your USC spouse may be able to add you to things like utility bills, set up a joint bank account (not all banks require a SSN to be put on an account), add you to a lease, etc. NVC is a different federal agency, part of the Department of State whereas USCIS is part of the Department of Homeland Security, so yes, NVC can request more information even though USCIS already approved the I130. Good Luck! -
This seems relevant. File the I90, it is a pain that USCIS will did not properly acknowledge your AR-11, and hopefully you will get the proper NOA from that filing. Good Luck! (U) Spouse and Children of U.S. Armed Forces Members or U.S. Government Civilian Employees Stationed Abroad: (a) (U) The LPR spouse or child of a civilian or military employee of the U.S. Government outside the United States pursuant to official orders, who has resided with such employee abroad, does not require a visa if: (i) (U) The spouse or child possesses a valid or expired Form I-551; (ii) (U) Has gone abroad accompanying or following-to join such a spouse, or married the U.S. Armed Forces member or U.S. Government employee while abroad, even if the LPR has been abroad more than 1 year, provided they would have been eligible to receive a visa as a returning resident at the time the marriage occurred; (iii) (U) Resided abroad while the employee or service person was on duty abroad; and (iv) (U) Is preceding, accompanying, or following to join the employee or service person (principal) to the United States; and (b) (U) In interpreting the provisions of 8 CFR 211.1(b)(1) waiving the visa requirement for the spouses and children of Armed Forces members or U.S. Government civilian employees serving abroad, the Department of Homeland Security (DHS) has held that: (i) (U) The spouse or child need not physically accompany the Armed Forces member or civilian employee to benefit from the visa waiver if the LPR is preceding or following-to-join the member or employee; (ii) (U) An LPR who does not physically accompany the Armed Forces member or employee to the United States must possess evidence that they are the spouse or child of a member or employee who was stationed abroad on official orders and that the spouse or parent was previously lawfully admitted for permanent residence; and (iii) (U) To benefit from the waiver, it is not material whether the member or employee was discharged abroad, or whether the spouse or child is residing in a country different from that in which the principal is stationed, provided all other criteria for the waiver are met; and https://fam.state.gov/fam/09FAM/09FAM020202.html

how to handle RFE
Dashinka replied to salman_shah's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
It is unclear what process you are in. Is this RFE from the consulate interview, or are you at the NVC stage, or doing AOS? Maybe provide a picture of the RFE with personal information redacted. In the end, it seems someone is looking for more evidence of a bonafide marriage, so your only option is to provide any additional information you have showing a commingling of the marriage (things like leases, joint bank accounts, etc.), maybe photos or even affidavits. Good Luck! -
For those that think only Trump is petulant, here is the current, mentally challenged, WH occupant showing his petulance. I guess Old Corrupt Petulant Joe thinks the press should toe the line. Of course his problem is that it is the people that are seeing their paychecks shrink with respect to purchasing power. Biden scolds media for negative coverage of economy: 'Start reporting it the right way’ "Start reporting it the right way," he added with a smirk. https://www.foxnews.com/media/biden-scolds-media-negative-coverage-economy-start-reporting-right-way

Seems to be referring to the idiots in DC destroying the country, but I suppose that does not fit your narrative, or at least the narrative you are parroting from the MSM, DC elite, and Democrats. Whatever. For some reason we heard Trump instituted a Muslim ban, but it included the DPRK, and Venezuela (didn’t realize these countries were predominately Muslim), and he forgot about Indonesia, Malaysia, Saudi Arabia, Pakistan, etc. seems it was pretty ineffective as a Muslim ban.

A little confused. The OP seems to indicate the first petition was filed for the son, and now the new I130 is for the mother (I assume there was no previous petition for the mother). If that is the case, you would indicate the son’s information in Part 5, and the city where you live(d) when you filed the I130 for your son in your mother’s I130. I don’t think the fact that the mother is in the U.S. and planning to AOS is relevant here. Good Luck!

Look at the I864 instructions at the top of page 9 (for some reason, I cannot copy it on my tablet). It explains what to do if the person submitting the I864 (your spouse in this case) is not required to file taxes. He will need to include an explanation as to why and include it with the I864. Good Luck! https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

Not sure anyone is paying attention, but Germany is having a bit of a difficult time economically. Germany uses the weapon of climate change against its own people The drama kicked off when Germany’s coalition government led by Chancellor Olaf Scholz found itself in a bit of a bind recently. Team Scholz had quietly moved €60 billion from a Covid-19 pandemic support fund into a green energy transition fund. The opposition noticed and finked to the court – which told Team Scholz to put the cash back because the sneaky move was a blatant violation of a law that had been ushered in under former Chancellor Angela Merkel specifically in an effort to ensure that the government was never able to bury itself in debt. Whoops, too late. Subsequently finding themselves underwater on the overall annual budget by an estimated €17 billion, they set about looking for ways to plug the hole. Farmers, Team Scholz apparently figured, can at least be bilked for cash on the pretext that the government tax subsidies for the sinful diesel fuel that powers their equipment deserve to be canceled – sacrificed on the altar of climate change. It all sounds so virtuous, and not at all like scrambling to compensate for a major screwup. https://www.rt.com/news/589653-germany-berlin-climate-farmers/
