  1. Here is what I would do. File the I751 as soon as the window opens, then 2-3 weeks later file the I131 (either DHL to the appropriate lockbox, or through your relatives). Once the first biometrics appointment letter arrives (I assume someone is getting your/her mail daily and can let you know), travel to the US. Hopefully, the 2nd biometrics letter will arrive shortly after, and she can take both to the appointment and complete both. The extension letter for the I751 should have arrived by then. Of course this is all hypothetical from a timing perspective, but it could work. Good Luck!
  2. I am not quite sure how best to time everything. Technically the I131 has to be filed from within the U.S., but there is a FedEx/DHL option. Others can chime in, but I suppose you could send both the I751 and I131 to their respective lockboxes and wait for the first I797 NOA requesting biometrics, and then get her to the U.S. If you have relatives or contacts in the U.S., you might be able to send it to them, and let them mail both from within the U.S. You also need to make sure the notices will get to someone that can notify you of their receipt. If you do it that way, (if possible, others can comment), you might be able to keep the visit relatively short. Good Luck!

  4. Ok, are they inside or outside the U.S.? Since this is an F4, I doubt they were doing AOS, so maybe there was a mistake on the I130.
  5. She can do that next time she is in the U.S. regardless of the I751 status. Probably best to have it ready to go when she comes back for the I751 biometrics, and submit it immediately upon her return. Hopefully the biometrics are at the same time, and then she can leave when the extension letter arrives assuming she has fulfilled the biometrics for the re-entry permit. She can have the re-entry permit card sent to the consulate in India after that.

  11. Quite a few moving parts to this. Do you and your wife plan to stay in India for 2-3 years? This plan will work for the two of you, but your step-daughter will have a much more difficult time. Normally, I would agree that doing the I407 is the best route for couples planning to reside outside the U.S. for an extended period of time, and then if and when a decision is made to repatriate, a new I130 can be submitted, and the foreign spouse can go through a new visa process instead of trying to maintain their LPR status through re-entry permits or the SB1. However, with your step-daughter it is another story. She already has her LPR status, and with her plans to come to the U.S. for school in 2-3 years it is probably better for her to try and maintain her LPR status through re-entry permits to avoid the pitfalls of trying to get a non-immigrant student visa, or the fairly long time period it would take for her to get a new F1 or F3 family based visa if she wants to repatriate to the U.S. permanently (8-10 years for F1, 14-16 years for an F3). No one can predict what a CO will do with a student visa application in 2-3 years, but convincing the CO that there is no immigration intent is a high bar. In the end, it is up to you as a family to decide. Good Luck!
  12. Personally, I would just keep it for yourself and bring it to the interview in case any questions are asked. You can add a short explanation of your current relationship with your foreign spouse with the AOS package, but I would keep your full relationship history for an interview. Also make sure you review that with your current spouse on the off chance you get a Stokes interview, and they separate you. Good Luck!
  13. Sounds like the CO is saying you will need an I601 waiver request to deal with the previous counterfeit document. All is not lost since the CO stated a waiver is possible (refused does not mean denied or revoked), but it will take more time. I suggest researching the I601 waiver form, most folks employ an immigration attorney for this, but I have heard of folks doing it by themselves. Read the required and interview evidence requested in the N400 instructions starting on page 10. I assume you are filing from in the U.S., so you only need a copy of the GC and marriage certificate to actually file. If filing online, you can upload the interview required evidence as well.   16. I agree, there may be more scrutiny, but I feel enough time has passed, and you successfully naturalized that this scrutiny may not be too bad. Make sure you keep a detailed timeline of your relationship(s) to show this was not the case of getting your LPR/USC status, and immediately turned around to sponsor a foreign spouse. Good Luck!

  18. If a new employer would not accept the expired GC and I797 extension letter as valid proof of LPR status as shown in things like the CBP Carrier Guide. One could always get an ADIT stamp for valid proof of LPR status. I don’t frequent Reddit, but this just seems like someone’s opinion. Maybe they had a difficult employer that needed education, or something like that. Regardless, there are ways an LPR going through ROC with an expired GC to show proof of LPR status.

  20. I am not aware of a specific naming convention. If you can save the file on your computer as a PDF with a particular name you should be fine uploading them as the files will be attached to a specific case. Good Luck!
  21. I completely agree with with @nastra30. A student visa will definitely be tough task in the future as it is treated much the same at the interview stage as a B2. It seems her options are to file the I751, and if possibe come back to the U.S. and submit the I131 and stay for the biometrics. The other option is to file the I407, try for a student visa if that comes up, and if she does want to come back to the U.S. as an LPR it will be a very long wait. Good Luck!
  22. I agree with @nastra30. I would do whatever to keep her LPR status if she plans to stay in the U.S. via a re-entry permit(s) or SB-1 although I think SB-1 would be a long-shot. If she is planning on staying in the U.S. getting an immigrant visa after she finishes school, assuming she gave up her LPR status will be a long wait. Good Luck!
