I doubt that will ever happen as there are always going to be exceptions, so what would you still carve out? Personally, I like this plan of bonding for an NIV, and would like to see how this trial works (it is not clear if it would still restrict AOS from an NIV). I am not fond of being restricted to specific PoEs, and would be curious as to why those. We shall see how it goes, but my wife and I would have gladly paid the bond for her to come and visit on a B2 prior to her eventual immigration just to make sure she could deal with a a move to the US. It worked out for us regardless, but how many stories have we heard where the foreign spouse, or SO really could not adjust and the USC spouse or SO did not really help.

Going to put this here. It is amazing the way the extreme left will spin things, but whatever. It is ironic that this gathering is happening in the UK. I guess as long as they don't protest the UK government or their "progressive" polices they will be fine. The other thing I find ironic in this piece is the name of the political party "Socialist Equality Party". I know, in socialism, everyone is equal, but of course some are more equal than others. 1. Yes, she can fill out the I864A. 2. I do not believe you need to update your own I864. 3. This one is a little trickier, make sure you fill out the parts at the end regarding the interpreter, and preparer sections. You may consider finding an impartial interpreter just to avoid any appearance of a conflict of interest on your part. Good Luck!

I-130 Expedite Chance Due Surgery?

DCF is no longer an option short of withdrawing the current I130. But that is a big risk as if the consulate does not accept a filing, then you have to start over with USCIS. I would not take this route unless I was almost certain of DCF. Good Luck! -

I doubt anyone can predict the chances for approval, but you certainly can apply and it sounds like you may have a case. The question is where is the I130 currently? This is important as it will tell you where the expedite request needs to be sent (i.e. USCIS, NVC, Consulate). If at USCIS and the expedite is approved, you will need to submit another expedite request at the subsequent stages of the petition. Also keep in mind that an expedite may not result in immediate action, but if approved, it may speed things up a little. Good Luck! -

What is the plan? You have two options, stay and adjust status, or he returns to his home country and you pursue consular processing. Both take a similar amount of time, but if he stays and adjusts, he cannot work until the employment authorization or green card is approved, and if he leaves the country prior to getting advanced parole, anything submitted will be abandoned. If consular processing, then he would stay in his home country, but he can still use his B2 to visit at the discretion of CBP. Either way, both paths start with filing the I130 along with the evidence required for that form. Good Luck! -

That is my big question. If a child derives citizenship from their parents naturalization, their names listed fully on the N400 of the parents, why are they not also included in the SAVE database? It seems weird that the only way they get recorded in the SAVE system is if they file for a CoC at some point, but possibly that is simply speculation, maybe they are recorded in SAVE even without a CoC (does anyone know for certain?). Again, I am not against anyone filing an N600, I just think the cost is way way excessive, and USCIS's explanation for the costs increases is a bit sketchy.

Hiring an attorney for immigration related petitions is not just a hire and forget endeavor. The petitioner (your boyfriend) will need to still gather all the required information required for the I129F, and check over anything filled out by an attorney prior to signing anything. Keep in mind attorneys make mistakes, and we have seen quite a few stories of that here on VJ, so both you and your boyfriend should study the I129F process and understand it as much as any attorney so you both can check over anything submitted on your behalf. As @Lil bear stated, VJ is a DIY site although there are certainly members here that have used attorneys, but if your boyfriend is confident in filling out forms, and there are no issues like a visa overstay, or criminal issues, it is fairly easy to go this yourself. Anyway, it is entirely up to you and your boyfriend, but when vetting an attorney, make sure they are competent, steer clear of any attorney that claims they can speed up the process, and make sure you review and check anything that they plan to submit on your behalf. 1. Seems pretty standard 2. Final background checks, etc.. The consulate could be waiting on information from the local government, etc. 3. No, this is all handled by the consulate unless they find some irregularities, and then they may request more information from you, or the beneficiary 4. Notification will come through CEAC. I agree, of course with the DoS, it would be hard to use SAVE as natural citizens are not included. Hence someone has to send in a BC, or CoN, or parents CoN, or CoC to get a passport and face the possibility of losing it via our mail system and the subsequent N565 fee ($505/555). As an aside, back in 2018 when my wife naturalized, the passport office/agency attended the ceremony and extended the offer for newly naturalized citizens to come to their office to apply for a passport within the next 30 days, without the need for immediate travel plans, and not requiring one to relinquish their CoN. My wife and I went the next day as her ceremony was in the afternoon and the passport agency was already closed by the time the ceremony was finished, they copied her CoN, and had a supervisor approve the copy, and since then my wife's CoN has not left the safe. COVID seemed to change that and at a recent naturalization ceremony I attended for my cousins (also in Detroit), there was no passport agency reps there, and I understand you can only go to a passport office agency in an emergency.

Interesting read. What piques my curiosity is if a child derives citizenship through a parent's naturalization, isn't that child also recorded in the SAVE database as a derived citizen? The posted review seems to indicate that only happens when the child gets an CoC via an N600. The discussion on fee increases, waivers issued, etc. was very interesting indeed going from $160 in 1998 to $600 in 2010 to $1170 in 2016 to now $1335/1385 depending on online vs paper filing, a massive increase in 27 or so years.
