I've never heard about an AOS from F1 that didn't require an interview. Are you just nervous? I can speak from experience that the whole process (for us at least) was entirely painless. Even if things go rougher for you than it did for us, I'm sure it'll still be easier than you think.

Don't really want to be in the marriage at this point. You know the phrase "cheaper to keep her?" It's like that. I file for D and she will get about $3k/mo, and no doubt go on public assistance which I may have to pay back. Everyone loses.

Definitely file concurrently (at the same time, in the same package). The guide just mentioned should help step you through it. Before you jump in filling out forms, go through the checklist and see what documents you need to send for. Some people don't have a birth certificate handy, for example...

Filing the I-130 by itself will do you no good. You have to file the I-485 along with it to have any status in the US.

Is it allowed? Yes.
Is it a good idea? No- it would be a big red flag, esp if you and the ex are fairly recently divorced.
It's great that you and the ex have a good relationship- I do with mine too, and he even had my current husband's best man stay at his house for the wedding, but USCIS/ the CO doesn't know the details of your relationships and will be suspicious.

I try to stay away from these forums as much as possible because of condescending (and scaremongering) posts like this.
We know this lady's back story, and we know AOS exists for overstays who have met "The One"
It isn't "visa fraud" to skip that return flight back to Europe when there are plans to marry and stay with your USC. That's exactly why AOS exists and overstays are overlooked in those cases.
Seems to be a lot of venting and hard feelings bubbling deep down in the posters here who went down the arduous CR-1 route.

Marry there a file for AOS so you are covered as immediate family and file there so you have some status... Give yourselves that piece of mind. Don't pay attention to the haters, remember most of the country just went through a terribly cold winter and the thought of living in Hawaii brings out some jealousy.

I say it again!!! If you are an immediate family of US citizen and overstay your I-94, you are allowed by law to adjust status while you remain in the USA. This law of being illegal doesn't really applied to immediate relative because they can adjust their status. Overstaying your visa Is not illegal if the permited stay on the I-94 exceed the visa expiration date. I say again, it's not illegal
