    Make sure you meet in person if you haven't already. That's a requirement for the I-129F.

    If you haven't met, personally worry about meeting and see where your relationship goes from there. Talking about marriage after knowing someone for four months and (maybe) not having met them in person yet, can be a pretty red flaggy thing.

    Personally out of everything you said, your short meeting time is more of a red flag than anything else. USCIS should know about you coming in on a tourist and changing to student, they may not know about your checking account or Drivers license, but it's their job to know about your past visas.

    Filing shortly after a divorce isn't always a red flag, it depends on time known each other and if there is anything else odd with the case.

    The ban is gone after 5 years, as it only lasts 3.  But that does not mean that a visa will be approved, it just means that it CAN be approved. Because he overstayed before, it will be difficult for him to get any kind of non-immigrant visa as they are afraid he will overstay again, especially with a US fiancee in the mix too.

    The ban may be up but the overstay will remain on his file. His credibility is tarnished and any immigration officer will take a look at his history and decide if he can be trusted with a new visa. Looks like the IO made a decision that he should not receive a visa at this time. Like said, any future non-immigrant visas will be hard to obtain.

    No it's quite possible that they will ask for proof of legal presence before scheduling an interview.  They do that in Montreal all the time.

    That's not quite how it works, he can schedule the interview in France, he has to pick an embassy and only after the interview will
    they say A. approved or B, you are undocumented here and therefore the visa is refused, get legal or interview in Senegal. Not before.
    He is currently in the process of fixing his status and the petition should be delayed and frontloaded with correct legal status for the desired
    outcome.

    Would they say no because you have no proof or would they say no because you never got religiously married. They don't like technicalities, and they don't like being played with either. You say it happened, just because you have no physical proof doesn't mean it didn't happen.


    Obviously at some point this religious marriage was something that ya'll did so she could meet you, if they called HER parents would they says he was religiously married or not? 

    What religion do ya'll practice?


     


    Also, it's helpful to note that K-1 is for people who intend on getting married. It's a fiance visa. You say your school work is done next month and now you want to go be with your girlfriend, and that you are going to get married in two years in sengal. Are you going to do a court wedding when/if you come in on a K-1? Because you can't just come in on a K-1 to live, you HAVE to get married (or leave) and then you have to apply for adjustment of status.



    And again, sometimes too much information hurts your case. You went from being religiously married to someone for 3 years (important to show your relationship), to it was just over the phone and you only did it so your girlfriend could come to France and meet you (much less important), to you're not even sure if it's really a real marriage so why does it matter anyways (Now unimportant)

    No.  Never lie.  If you are married religiously you may as well finish the job and apply for the CR1.  There is such a thing as too married for the K1 and not married enough for the CR1.  Right now you are in that area.  
    Also you cannot interview anywhere that you do not have legal presence.  So you will have to interview in your home country.

    If you have gotten married religiously and USCIS finds out about it, they most likely will find you to be "too married" for a K-1. Just because you aren't LEGALLY married on paper, doesn't mean USCIS doesn't recognize religious marriages as being married. In this case if they deny your K-1 because of that, you'll have to go marry in another country or get a visitor visa to the US get married here and go back to your home country and then apply for a CR-1 visa.


    And yes, they do care if you are legal or not. If you're willing to break other countries immigration laws, you'll be seen as willing to break US immigration laws.

    Transborderswifes question was legitimate. Yes the boards allow for non immigration issues- however this is not the correct sub-forum. This is Effects of Major Changes (on/re immigration matters). The OP does not have an immigration concern at this time (as per his follow up posting). So this thread is in the wrong section. (reporting for it to be moved). It has nothing to do with not having a heart- but keeping the forums organized.

    I would go with the job, since its 3 hrs commute Mon morning, , back home Tues nite, commute Wed morn,& then
    Fri go home, if she has your back as a partner she'll understand you staying in a motel M,W,TH evenings of the week
    to give the family a better life, she could take a trip at times to come chill with you.I think shes selfish. OP is it
    that you have not yet finish in the process of obtaining a GC & she is being manupulative.Take the job & commute

    That's was fairly confusing.  Is it a personal story?  It's make more sense then.
     
    but my basic gist of it is Jane's citizenship as well as her mothers is fraudulent.
     
    what could happen?  She and her mother could lose their citizenship and be removed with a lifetime ban for misrepresentation.

    If your sister insists to get married to the scumbag I would call DCF and tell them about the abuse  that your niece suffered, and probably DCF will take your niece away from your sister, she failed to protect her daughter and she  is putting her daughter in harm's way AGAIN. She should care about her child's safety and if she doesn't  care then be your niece's voice. Speak out against Domestic Violence!

    Why on earth did she bail him out ?

    What about him being a danger to her and her child ?
     
    He is NOT going to change.
     
    Change locks, file restraining order and move on is what she needs to do instead of settling to be his punching bag.
    I just don't get why she bailed him out. That's crazy.

    Immigration fraud (using a non-immigrant visa - like ESTA - to arrive in the U.S. and immigrate) generally involves lying.  The first lie could be buying a return ticket when in fact you have no intentions of using it.  It is also serious and can carry a lifetime ban.  
     
    You are really asking us to help you start of your marriage with the woman with whom you are 'so in love' with a lie and fraud.  No we are not going to do that.  
     
    Bad karma anyway.
