Yeah, I added our marriage certificate and all the necessary documents. I just feel like I could have added more evidence for our marriage section. Should that be a big concern?

If when they get to your Petition they want more from you, they would hopefully send you an RFE (request for evidence) and you'll have a reasonable deadline to get that info back to them.

Depends on the CBP officer, but if they followed their own regulations re: document requirements for air travel -- https://www.cbp.gov/travel/us-citizens/whti-program-background/docs-air-travel

"Lawful permanent residents must continue to present a valid Permanent Resident Card. A passport is not required."

Thanks. The guy I saw must have been having a pretty bad day!

not country specific, it applies to all.

many many GC holder in the same situation like yours and they are from all around the world ( passport = maiden, GC - married)

always book ur flight ticket with the name listed on the passport. all airline adopt the same rule.

    US- Brazil

check in : show Brazil passport

    from Brazil - US

check in : show passport and GC. if airline staff ask about name discrepancy : show marriage certificate.

landing : show GC, if CBP ask for passport ( they rarely ask), show ur brazil passport

I'm surprised to read they rarely ask. Granted, I've only flown twice with it, but both times I was asked for my British passport. The first time, the officer yelled at me because I should have known to hand it to him with the green card 😆

  4. A tier 2 officer may very well be able to help you. Not a guarantee, but they have more power than the phone reps. I think you should call back, get a rep on the phone and politely but firmly request a tier 2 officer, explaining you sent your medical in but it was not reviewed despite them confirming receipt. It's either that or you would have to pay again. I don't think you should if someone can locate the documentation and review it.

  5. I'm not sure if you can report him to the state bar? I honestly don't know if that is a worthy complaint. That's such a basic requirement for an I-129F that I question whether he could possibly handle complicated cases. If he knew you wouldn't get approved at all and mislead you on that I would even go so far as to say he stole your money. I'm so sorry you had to experience that.

  6. I encountered this scenario when I wanted to live with my then-boyfriend. It just wasn't possible via school or work for me. We ended up getting married and I got a spousal visa, but of course because there was no way for us to know each other properly prior to marriage, we did get to know each other post-marriage, and it didn't work out 😅

One of the drawbacks to international relationships, unfortunately. It's a risk you take. I don't regret the experience at all, though.

  7. I think you will need to write to them and inform them you are filing for divorce and need to convert to divorce waiver, they will send an RFE for the decree (which you won't have due to the one year rule in NY) and then your ROC would be denied. You're in a pretty awkward situation here. You can't go through without telling them in case they approve you without interview, but if you tell them now, the RFE deadline would expire probably before you can even file for divorce.

You can re-file after a denial but you do put yourself at risk of being deportable in between the denial and their acceptance of the new I-751.

Thank you for your response. Was this Nashville specifically or just a general experience?? I'm flying out on the 21st of December so hopefully I have no issues as it's so close to Christmas. I'm happy to hear your experience went well, hopefully I'm up against an IO as sweet as yours was haha.

General experience. I used to come in through Newark Liberty 🙂

  9. I visited my ex-husband a year after we got married and my CR-1 was at NVC. The officer who let me in was a woman about my age back then and she thought it was super cute that I was visiting while the visa was in progress. Hopefully you'll have a similar experience. As others have said, it's a crapshoot, but I think the odds are on your side.
