    If you apply for PR via the outland method, it does tend to go quicker than the inland method. We got my US husband's PR after 10 months. This was back in 2009-2010. I know a couple now who we doing outland and I think have already passed their 10 month mark and are still waiting! They mentioned something about a strike. Your husband will need a medical exam along with the FBI fingerprints.

    THIS IS THE POST I'VE BEEN WAITING TO MAKE!!
    My husband just got his visa approval today!! It feels like a second wedding day because they are finally letting my man come HOME. yes we cried!
    Thank you everyone who put up with my fretting and thank you everyone who read and commented and thank you ESPECIALLY to the mainstays on this forum who always have a word of sense and advice. I won't name you because I don't want to accidentally leave anyone out, but you know who you are
    Let's all be good to each other, folks. I want everyone to have this feeling of joy and relief.

    If you are flying into Montreal for even a night and staying downtown, do not take a cab to your hotel! It is $40. It's a flat rate. No wiggle room. However you can take a bus that stops along Rene levesque both to and from the airport. It's $9 for a ticket for 24 hrs (you can buy 3 days for $18) right on the arrivals level of the airport. This ticket also let's you use any bus or metro.
    Just to add it takes the same amount of time to ride the bus as the cab. The bus has special spots to out your luggage as well.

    You're simply a stepping stone to him. That's all. IMO/E, all of the stuff he said to you was simply bait.
    Here's a thought - fill up your voicemail on your phone, so no one can leave any more voicemail messages.
    When you get in a call you don't recognize, send it to voicemail (which will then give the caller a general error message)
    If you'd like to file a report with US ICE, you can certainly do that.
    You dodged a bullet, for now. Burn some joss, seek some therapy, walk away.

    It sounds like you can't provide for your family and want a free ride just because. Sorry. Your wife can get a job or you can get a better one. Next year it will be illegal to not have health insurance.
    Part of sponsoring an alien is proving that you can support them and pay for them, and that includes insurance. The government and the taxpayer doesn't want people to come here and take public benefits. She cannot get them. Period.
    If she gets pregnant and has a baby you'll also need health insurance for the baby.

    IMO, the manner in which he made his shift,
    speaks volumes to his attention that he's giving his mother.
    I say do the American Thing, instead, and take him to the cleaners in a divorce settlement.
    But that's just me.
    His mom has been very busy, and found a girl for him that SHE likes. Is best to punch all with a decent attorney.

    If you both know SO much about this process, why are you here pestering VJ members? Clearly, everyone else besides you two realize the gravity of the case. If you don't care for what information the members have gathered for you by taking the time to do so, you can LEAVE this site. For the umpteenth time, EVERYONE thus far have given you answers that are HONEST, LEGAL and CORRECT. You've been told what forms to fill out, you've been told where to gather the forms, what documentation should be provided with the forms, what steps come after those forms are filled out, how many steps are involved, you've been told about the fees, you've been told about the financial responsibility, and even why this process is not valid for you both yet (because the GF is under 18 and she cannot petition until 18, regardless of whether she can marry or not). What more do you want?
    The only people passing "smartarse" comments are you both. Cut the nonsense, read what the posters have wrote-ALL YOUR ANSWERS ARE THERE. You came here for help, you've been given help. If you don't like the answers you see, GO GET A LAWYER-that would be the ADULT AND MATURE thing to do, as you both claim yourselves to be.

    This 'geezer' decided to ask an attorney friend about this for you.
    In his opinion
    "The petition would probably be invalid even if the marriage is valid because a minor would not be able to be held to the conditions of the I-134 affidavit of support. Under federal law and various state laws a contract with a minor is not enforceable. Someone who has not yet reached the age of majority cannot sign a legally binding contract, some exceptions are made in the cases where legal emancipation has been processed through the court. This is because a minor can disaffirm a contract made, no matter the case. The I-134 is a binding legal contract between the federal government and the petitioner with conditions, rights and responsibilities. When a contact is disaffirmed the entire contract must be disaffirmed. in this case it would require reversal of the entire immigration process without condition or penalty, which is also not permissible under federal law."

    Because you are going to be lazy... I'll give you the links. Within the links are the forms, and information you NEED to know. Then at the end of this post I will write it out. However, because of your age you may not be able to sign these forms. You may need to wait until you are 18. I suggest talking to some immigration lawyers about it as well.

    STEP ONE:
    US spouse files an I-130 petition (henceforth called the Petitioner) with the USCIS
    included in the petition are two G-325a forms which are biographical information, 1 is for the petitioner, and 1 is for the beneficiary
    1 passport style each
    Photocopy of US spouse's birth certificate or naturalization certificate or entire passport if the spouse is a US citizen (which you are.)
    Marriage certificate (photocopy)
    and divorce decrees (photocopies)
    evidence of a bona fide marriage as detailed by the I-130 instructions
    If approved the I-130 petition by USCIS, it is sent the National Visa Center (NVC)
    STEP TWO:
    Foreign spouse (beneficiary) sends DS-3032 to NVC
    Bills are invoiced and paid by the US petitioner from a US bank account
    US petitioner sends an I-864 Affidavit of Support
    (if the US petitioner cannot meet the I-864 poverty guidelines (as defined by the I-864P on the USCIS website) they need a joint sponsor who DOES meet the guidelines. The AOS document states that the beneficiary will not use means tested benefits or else the sponsor(s) can be sued. This contract with the US government is effective until the beneficiary becomes a citizen, leave the US permanently, or acquires 40 work credits (the equivalent to working 10 years approximately.) The contract is still effective if you divorce. The contract is still effective if a person remarries. It doesn't end until such a time as one of the criteria for it to end has passed.)
    Beneficiary sends DS-230 with all necessary documents to the NVC
    After NVC receives all the documents, reviews them and considers the package complete, they book an interview with the consulate or embassy when a spot is available.
    The beneficiary must book a medical with a panel physician in their home country and then attend an interview at the consulate or embassy.
    An immigration or consulate officer will approve, deny, request more information or place the beneficiary in administrative processing of an indeterminate amount of time.

    Then I would suggest that you consult with a lawyer who can assist you with filling out the proper forms. I stand by saying that reading the guides and re-read them again. But the DIY process is not for everyone and perhaps you would be better served with a qualified immigration lawyer as there are not too many of us "geezers" who went through this process as minors.

    I don't know if you have to be 18 or 21 to file an i130 (first step for CR1)... I doubt that you will be able to sign a contract until you are an adult.
    People are not going to type pages of info just for you when it is a click away. The cr1 process is broken up into 3 stages all with their own rules and sets of forms. The first is the i130 packet that has to be sent to the USCIS - that is your first concern,, learn those forms & requirements first.

    Just some observations about the CR-1/K1 process.
    The visa process can be seen as sort of a trial by fire.
    Consider this.
    If you are impatient… you should reconsider.
    If you are easily upset or angered… you should reconsider.
    If you have money problems… you should reconsider.
    If you have difficulties understanding legal documents… you should reconsider.
    Be aware of this.
    Expect the process to take a long time.
    Expect to be tested mentally and emotionally.
    Expect to pay repeated fees, travel expenses, as well as being able to support both yourself and the beneficiary for a long time even after they are here.
    Expect to be judged and scrutinized based on how you look on paper and in person.
    The view of USCIS and the embassy.
    You are guilty of visa fraud. You must now PROVE that you are not guilty and your relationship is real. If it’s real then you will wait as long as USCIS deems reasonable.
    You are guilty, belligerence or arrogance will not be tolerated, and your feelings are a moot subject and do not matter.
    You are responsible for ALL financial matters related to yourself and your beneficiary from now until the end of time. Your ability to support your family WITHOUT the assistance of the beneficiary MUST be proven. You will not be allowed create a potential burden for taxpayers by bringing a person into the county.
    Your age even at 18 will be viewed with suspicion. Your financial ability will be viewed with suspicion. The validity of your relationship will be viewed with suspicion. Your maturity will be viewed with suspicion.
    After all that… The entire process can come down to the OPINION of one person, who you may or may not be allowed to speak with for only a few minutes. Without the time or ability to plead your case.
    This is not a light decision. It will affect the rest of your life. It is expensive, time consuming, and painful. It is intended to be difficult. We choose this path because we have no other choice. We choose this trial of fire rather than losing a part of our soul. Even a man who displays absolute bravado will quietly admit that asking him to live without his wife/spouse/fiancée/asawa is like asking him to live without air.

    After almost 7 months, my IV package is on its way to NVC...
    I went to DHL it this morning here in Natal, and in a normal chit chat with the owner of the office I actually found out that his son had gone through the same process almost 2 years ago. We shared similar experiences ( USCIS being slow, the bureaucracy of it all ). I joked about how much weight a half-a-pound envelope could have and he was sympathetic to it. Mr.DHL offered me some words of comfort that I would like to share with you all.
    "Distance is not for the fearful, it is for the bold. It's for those who are willing to spend a lot of time alone in exchange for a little time with the one they love. It's for those knowing a good thing when they see it, even if they don't see it nearly enough."

    Helpful info for anyone in Toronto!
    If you might not know what kind of vaccines you've received by your family doctor, etc you can call Toronto Public Health and request a copy of your immunization record. I can't remember the number I called. With some research I found two numbers; the number for Toronto Public Health is 416-338-7600 and the number for Immunization Information Line is 416-392-1250. When I called in, the lady was very nice and helpful.
    I got my records mailed to me and received it in 4 business days from the call.
    It'll be very helpful for your medical exam when the time comes.

    All depends where you are in Canada--each police station varies--but normally it is 1 of the easiest documents to get.
    NO criminal history = NO fingerprinting required
