    Folks,
    My husband works for DHS-USCIS. He has informed me that there have been a massive number of lay-offs in all departments of USCIS in the past few weeks. 
    I would suspect this would cause more delays for processing. 
    Let's hope for the best, but prepare for the worst.

    Yes, I do realize things can change and that is why I am wanting an suggesting that they change that law so that people here on a tourist visa can not adjust status. I am not forcing couples to live apart at all, I am simply saying that we should allow the rule of law to take affect. I am not irrational and my feelings are not misplaced at all, I am simply stating that that people should be held to the SAME standard as everybody else and be forced to file a petition just like everyone else. How are you making people's lives easier if you are calling for simply skipping the line all together to go in the sidedoor instead of the front door? 
     
    I am all for allowing people that came here on a student visa that went to university here and achieved a STEM degree be allowed to AOS as long the proper background checks are done on that individual. But you may not know this but alot of the foreign students that are coming here to go to college are people from China. So allowing them to AOS here straight off a college degree could open up the USA up to loads of espionage cases. Which companies, government contractors, and the Federal Government is well aware of because China loves to place it's 1st or 2nd generation citizens in to places where it can gain information that is then sent back to China. You need to wake up to the real world and not live in fairy tale land.

    I understand the difference.  You don't seem to understand things.  German citizens do need their government's permission to go to certain places.

    You can expect what ever you want, the world does not bend to your wills or thoughts.  It's delusional of you to think that anyone has a "basic freedom" to go whereever they want without their government making restrictions.  Ever wonder why people have to get a passport to leave their country to travel internationally?  If there was a basic freedom to go whereever I want, then why do I need to ask my government for a passport?  

    You are mistaken your feelings of entitlement  to do whatever you want because you think freedom is absolute versus the reality and power of governments over their citizens' foreign travels and lives.

    You may want to check where North Korea restricts which of their citizens can leave the country.  Then, try China where the government refuses to issue passports to undesirable citizens (i.e. Muslims) .  Then, try a whole list of other countries that don't allow their citizens to go to Israel. 

    Please list one country where this "basic freedom" to travel to any and every country exists.  Just one.

    There is no such thing as absolute freedom. 

    There is no right to travel internationally to where ever you want for anyone.  Everyone of us human being is restricted on where we can travel to.  Everyone.

    You must document the trip to Cuba in your citizenship application and prove that it meets one of the 12 permitted criteria. It's then up to USCIS, not you or the travel agent, to decide if it does or not. There is a warning on the department of state website about travel packages claiming to be "educational trips" because they include a scuba diving lesson or a trip to a historical site when, in fact, the main purpose of the trip is to just have a holiday there.

    My husband works for the government.  He can be fired for putting an unknown USB device in a work computer (one of the few reasons he can be fired to be honest.) He has to use his security keycard to even make his computer operate!  They track every keystroke.  (Sounds like something the OP would do as well since they record everything... )

    God can do anything, but that doesn't mean He will act in your favor at the expense of all the others who filed before you. Patience is a gift.
     
    Average timelines were severely different in 2016. Until Q3 2016, timelines were about half (or less) of what they are now.

    How can anyone be confused by the VWP? Not only must you provide proof of a return ticket within 90 days of outbound date to be able to even board the plane here, the date you can stay until is clearly stamped in the passport. He also agreed to the terms and conditions when he applied online and checked the box that he was aware of those terms. The ESTA application website is available in various languages if English is not his first language. Just exactly how long did he think he could stay? Are you serious that the pair of you both thought he could stay the full two years or something? How long does it take to get to know your family? 
     
    So he overstayed and was caught speeding (or was with you whilst you were speeding) and you want to show an affidavit of his good moral character? They will laugh at that. Also his "strong ties" such as property ownership are meaningless because he left everything before for 157 days without feeling the need or the draw to return home. One wonders how long he would have stayed if he didn't get pulled over by the cops and the overstay discovered? How was he paying his bills back home while he was spending almost 6 months here? I assume he had things like property and auto insurance and utility bills to pay - they don't go away just because you're out of the country. Was he sitting at home in your place alone all day while you were at work? Can you say with hand on heart that he did not do anything at all during that time that would be considered work by immigration officials?  Even watching someone's kids or mowing the neighbor's lawn is "work". If I don't buy it that it was an innocent mistake and he needed 157 days or more to get to know your family you can bet the officer at the embassy won't either. 
     
    If you have the funds to do it, go ahead and apply. But I certainly wouldn't bet the farm on an approval any time soon. Being apart is awful. We have all been through it or are going through it. My husband and I spent the first 4.5 years of our relationship (including the first 2 years of marriage) living on separate continents and having short visits only and I promise you I do not love him any less than you love your boyfriend. But we all survive. If you're going to enter into a transnational marriage then the visa rules and regulations are going to have to become something you have to know by heart. There's just too much at stake to get it wrong.

    The posters in this thread ARE giving you information -- some of it quite crucial -- about the "legal process."  The entire petition and visa phases are a legal process.  The petition phase is the easy part.  Your perils will occur during the consular phase.  People are giving you details about what will specifically be looked for.  This ain't our first rodeo.
     
    Traditionally, the consular officers (COs) in Vietnam have expected a detailed "relationship timeline."  When petitioners and beneficiaries get engaged on the petitioner's first visit, visas have been refused.  HCMC is a very high-fraud consulate. You would do well to scrutinize the relevant Embassy Reviews (link atop any VJ page), paying undivided attention to the worst experiences, and to all the tips, insights, and cautions that have been offered over the years.  If you continue to dismiss the posters who warn you to be aware, and if you barrel ahead blinded by your own confidence or on the basis of success stories from thread participants who didn't go through Vietnam, be reminded that actions have consequences.
     
    People are trying to tell you, in frank-yet-kind ways and on the basis of collective experience, that you don't yet know what you don't know.  This is not an insult, because everybody starts "new."  This site is a gold mine.  Please read and read and read and read until you're aware of all stages of the entire immigration process and what they entail, so that you can receive and process meaningful input with circumspection.

    I am constantly amazed at the level of detail regarding a case that is provided by someone posting "for a friend". In this example, the poster was able to provide the names and dates of all forms filed. Not just on this forum but on the "other" (less helpful) immigration forum. The amount of time it must have taken for the "friend" to provide all those details to the poster and for the poster to create an account here, type it all up here, then copy and paste it elsewhere (after creating an account elsewhere), and to add to the posts on both sites two months later...the "friend" could have created his own account here and posted it himself in a tenth of the time. 
     
     
    Were you also posting for this or another friend when you asked about STEM degrees and TN visas last summer and when you asked about the procedure to bring a spouse to Canada? 
     
    Please don't waste our time. People here give their own time at no cost to you to answer genuine questions. Don't abuse the generosity. If you have a genuine question, please post it.

    No. As soon as your visa is up you either have to extend or go home. Your children can not petition you until they are 21.

    Refer back to my other post. It does not matter about right/wrong, what we want or need. I most certainly don't agree nor am I complacent. You know how I defend myself from this? I don't post things on the internet I don't want people to find, I keep my laptop webcam covered. Simple, really. Much easier than trying to slay the immortal dragon.  
     
    If there was truly going to be some kind of anarchy where people want to fight against how the gov't runs, power to those people. I am all for making life as simple and easy as it can be. Every country has its rules, its secrets, its good side and bad side. I am not going to chase after an unattainable cause because I don't like it. Many things are wrong in the world that I do not like nor agree with, but I cannot change everything. I am realistic. What I can do, is try to better myself as a human, be smart and work my way around things (i.e. privacy issues), help those in need, follow the rules of the county I am living in, respect the authority in charge and make life simple for myself and those around me.

    I do not care what YOU came here for. That is entirely your private thing. But me too I would NOT have come here if not for my wonderful wife. But what I am absolutely convinced is the following: no matter WHERE you move and what for WHAT reason: it is YOU adjusting to the society and culture you move to, not the other way around.
