EB2 there is a wait for the PD to be current, EB1 is current for ROW but I do not see many of those.
https://www.wegreened.com/ just an example of a Law firm that does these en masse and will give you a free assessment.
This is the firm where he submitted his details for an assessment this morning. A wait is fine.

Thanks. He submitted an evaluation with an attorney today and expects to hear their opinion within 24 hours. He only has a masters and not a PhD, so maybe they will find that he is not suitably qualified, but it is worth having them take a look. Nothing to lose.

I used to be fairly pessimistic but having seen many cases get approved which I assumed had no chance I have changed my mind.
There was a lady who was a regular on Hacking, an Accountant, she DIYd and was approved. Last I heard she was in Texas but having issues finding employment.
EB2 NIW has gone from very rare to fairly common. I know there was a Court case a few years back and I assume there has been a cultural change in interpretation.

I recommend you talk an attorney and do evaluation for his case. Now there is a premium process which get a decision within 45 days and most of the wait time will be for the NVC and embassy interview.

I read a statistic that the visa has a 77-85% approval rate. Maybe those are mostly super qualified people, but what I read stated that it's easier to get than an EB1 or a regular EB2. Obviously, we would not want him to pursue this visa if we thought he couldn't be successful in finding employment, because his wife and two kids will be in our house until he gets on his feet, and my husband really likes having his own space. And we both consider his kids to be pains in the neck. But, we do want family nearby.

Unfortunately that’s the answer to your question then I suspect.
He would need that sponsor and the company has to prove why they need him over an American employee in order for him to get that
This is why I was interested in this NIW option. He has been told by several that "we don't do those" but if he had a work visa without them having to do it, they would hire him.

He would easily find a job if he was in the US and already had work eligibility. There seems to be a shortage of computer science professionals. He has a lot of experience. I can direct him to ask an attorney to ask if they think he qualifies if this is not a DIY process like my husband's immigration.

It's nearly impossible to find an employer willing to sponsor a EB2. I've literally never found one, especially since he does not live in the US already.

Does he work in the medical field (doctor, surgeon, OBGYN etc?) that’s normally the only professions that are approved for that visa.
Just having a masters degree doesn’t make you eligible for that.
No, he is not in the medical field. As I listed, he is in the computer science field. I replied that he does have some publications that come up on google.

I can't believe I just found out about this visa.
My US citizen husband petitioned for his brother for F4 visa in 2015. As we all know, there are many more years of waiting for that.
His brother has a master's degree (computer science), and has a PMP certification (project management professional) and is doing well in his career. There are many jobs here in the US for which he has the experience and qualifications, however, very few employers are willing to sponsor.
Could this EB-2 NIW could be the answer for him?

Thank you. Yes, I'm well aware of the normal timelines. We were just attempting to assist with a humanitarian issue, and it appears we cannot.

There is Humanitarian Parole, the most common one here is Ukrainians, Afghans and Venezuelan
This category would not be his situation.

Yes, they participate in the diversity lottery each year. This wasn't a random "I'm feeling anxious and want this process to hurry up." and is actually a specific situation that falls under the humanitarian umbrella, but it seems that we cannot help.

Thank you. It is my husband's sibling. He has children (twins) who are 5 years old. The matter is urgent, but perhaps there is nothing we can do. We have tried and we will see what happens from here.

I don't know her tier. She just said that it was in the humanitarian category and it would be reviewed. Thanks for the further insight.

We just submitted an expedite request based on humanitarian reasons for an F4 application that was made 7+ years ago. Has anyone ever tried to expedite an F4 case? I'm curious to hear others' experiences.

You will get more specific help in the Adjustment of Status forum.

She would go to the authorities in her home country and get the appropriate documentation that shows proof of her divorce.

My husband and I have been very happily married for over 10 years now, and I was feeling nostalgic, so I came back to read this. What a crazy and stressful time in our lives!

I would petition everyone at once now, and then when your mom is able to petition your brothers, she can petition them at that time. You can see which comes through first. But, by petitioning your brothers now, there is no lost time in case your mom is unable to petition your brothers in the future.
Make sure you can afford your mom's medical care!
EB-2 NIW Visa

The first place we contacted said that his was not the type of case they usually take. We contacted another firm with a money-back guarantee and they were more positive about his case but asked him to complete a couple of things before they could evaluate further. It will be a bit of a process as he takes care of those items.
