    I haven't met any Nigerian family in the US in 30 years here who has more than 6 total in their family.
    Obi, just do the regular affidavit of support normally.
    No real red flags based on what you've shared so far.

    The Embassy doesn't care (and doesn't need to know) what your uncle promised you - it's completely irrelevant to the process. Have him fill out the I-134 (along with your fiancee) and provide all the supporting documents.

    Well surely don't go into an interviewing telling what he has promised. He makes enough for sponsoring so thts enough for a I-134. No read flags medical students petition all the time and well she is a future earner.

    When its olderwoman younger man K1's just won't fly in Nigeria. They want to see commitment. So do as they say marry. And hopefully this time next year you will be awaiting an interview or done.
    Look at our own Gowon how that man move chop chop and married filed and now home in US with his Empress.
    And you know especially for Nigeria meeting the Family is of utmost important very few get approved not meeting the family. I have heard that some CO's look at beneficiaries not living in their country and interviewing a way to circumvent (Hide things like other wife, kids stuff like that) so they really want you to meet family, friends, neighbors.

    Technically a CO can not deny you but return your case to USCIS with recommendation to deny.
    USCIS will send you a NOID/NOIR for your rebuttal and the decision is then made to deny or to send the case back
    to the consulate.
    They said case is closed because they refuse to deal with it any further at the post but your case is not dead at all for USCIS.
    Since the CO asked why you married in Ghana and not Nigeria, to me it stands out as a possible suspicion and refusal to approve.
    I would address the fact that it was you, the petitioner feeling safer in Ghana and that you preferred to marry there like you said in
    your comment above.
    It happens that some fraudsters marry outside of the country while being already engaged or (traditionally) married to someone else in Nigeria.
    They chose another country because they do not want to be seen marrying a USC at home in front of friends and most of the family.
    This is how the CO's think, they assume and speculate without hard evidence and cover everything under the umbrella of
    "not bona fide" with the slightest gut feeling.
    I hope he covered every angle in the interview about the marriage in Ghana, such as it was more economical and financially
    feasible marrying in Ghana than in Malaysia, mother and brother were closer since you insisted on Ghana and not Nigeria blah blah etc.
    Giving a shy answer that is not convincing reasoning would not do.
    If he studies or works in Malaysia they may really wonder why Ghana.
    Lagos likes to see a wedding with family and friends and lots of photos of it.

    Of course im sorry for the problems you are having with your husband. But quite frankly this is making me angry. You should not have filed in the first place if you werent sure about you husband. Because of people like you my baby son is forsed to grow up without his father! Because of people like you that take up government time that could have been spent on a case that really needed their time. Im sorry to be so harsh, but hearing that you have wasted all this time and now are looking to find a way to cancel your visa?! Do know what some people are ready to do to be at the stage that you are fortunate to be at?! Wanna know how to cancel? JUST CALL AND CANCEL. Dont waste anymore of their time. And this is not just you, you just happened to catch my attention in a very difficult time. There are alot of people who are filing for pr and dont really actually want it, or just arent sure. And im just sitting here staring at the "initial review" status day after day after day.and watching my little one cry for hours after he sees his dad on skype. This whole system of ontaining a permition to even enter us is EVIL. poorly designed. I feel like the government just doesnt give a ####### about the cases and how much pain brings every minute apart from your loved one. They just waste time during the day to get a payccheck and go back home at the end of the day to their families and cozy dinners. This is just ridiculous. For a country with so many advancements and such technologies, its just imbarrasing and ignorant.

    I would recommend to just let the visa expire in your case. It will be automatically be invalid after 01/2014.

    I did not pay for my Wife's fee in Nigeria and there was no question asked about it in Houston during POE.
    I just now submitted the fee last night after we arrived home.
    Good luck.
    PS: Personally, I would pay that fee ASAP, who knows what immigration debacle they can come up with new fees or higher fees, etc. Just my opinion.

    According to the US embassy if one is planning to migrate and is in petitioning process he/she is no longer eligible for a temporary visa as they think he/she is trying to cheat the system by living in the US on a visiting visa. With that said, persons who have a valid visitor visa while petitioning at times denied entry into the US by the IO due to the same belief
    "Often the immigration petition process can take years, and officers understand that you are following the rules and regulations for immigrating to the US, but still want to visit family while the process is ongoing.     Do not send your original birth certificate. The forms your fiance will fill out and turn in need to have original sigantures, not copies. Make sure he tells them that he needs his birth certificate back if he submits it. They will have the exact fiel that you submitted right there to ask questions from it. Good luck!

    I've been carefully to not say as such since the last time I said it I was almost beaten to a pulp on here eventhough it's true.
    I think part of what was said was that eventhough I am Nigerian male that grew up in Nigeria that I should not thump my chest and hold myself as an expert on Nigerian culture. VJ has gotten more relaxed or maybe it was my delivery.
    Anyways, OP has my best wishes on the journey ahead.

    I totally agree with you godlove it's difficult with the kind of culture we have to be in this situation. I can only pray she finds a result ion to this problem before wasting money filing papers. My mother herself who is nigerian scrutinises any girlfriends my brothers bring home. And in the past has been known to chase a few of them away lol. Just like in the past she has tried to find me a good nigerian husband etc no matter how many times you tell her you want to make your own choices. Just saying that parents have a huge influence on their kids in Nigeria more so the male than the females I feel. If I was her I would be aware of the potential problems that will arise in the future. My prayers stay with all of us in this stressful process.

    very well said Nurseling, I myself is a Nigerian female, and I can't imagin a Nigerian man wanting and willing to marry a woman who can never carry his baby, with the kind of culture Nigeria have I seriously doubt that this man is in for this for better, for worst and until death. He will leave her once that green card has been issued. So its best like you and others say to put this guy on a trial and tell him she rather move to Nigeria and live with him, and see how his reaction will be and see if he will accept that, maybe live with him in Nigeria for maybe a year or even 6 months and see if he can proudly intoduce you to his friends as his wife. Do that before even applying for him. I know you love him and he have probaly got you into thinking that he loves you but make sure that this man truely loves you and is genuine so you don't end up being hurt in the future.

    Its very obvious this guy is only with you because he wants to use you to get over here so so desperate and its a shame. My only advice to you is to run for your life, you can do better because when he gets over here, he will endure for maybe 2 or 3 years and once he gets his green card or becomes a citizen he will disappear and marry someone his age. Nigeria men are not stupid and no reasonable Nigerian man who wants to be with a woman who is 40 years older than him, a woman that can't give him children only if he wants something from that woman. iF your the man and his the woman maybe ya. The CO will know its for immigration purpose only and deny it but you never know, miracles do happen so goodluck.

    Loving America and loving your wife are two different things. Applying for America visa several times before meeting your wife is a red flag because it might seem like your desperately looking for a way to finally get to USA since you've been denied several times.

    there is a BIG difference between Australia and Nigeria..I mean HUGE difference. Nigeria has just about the highest incidence of fraud, if not THE highest. Plus the petitioner is female and far beyond child bearing years, a big part of the culture in Nigeria...really you are comparing apples to oranges.
