HI...my background is filed fiance visa... denied and put in administrative processing....if we get legally married while im in his country visiting him and come home file spousal visa....cause consulate sent me a letter to refile k1 or get married and file spousal ..... what are the chances of him being able to come here to the US to visit on visitors visa while waiting for the spousal visa.....he is from Nigeria and yes I do know he is from a high fraud country....thank you any answer would be appreciated

Absolutely zero because you have a denied petition on the books. So very strong immigration intent. Even without the denied petition the liklihood would be 99% failure for a young nigerian man. Especially married and wife is in US.

Remember he is to show strong ties to Nigeria not to the US. You are proving he has none to Nigeria and wants to do anything to get to US.

It would be hard enough on his own merit, but now throwing in the fact that you've applied for a fiancé visa AND have been put on AP, its really nearly impossible. There is a question on the visitor visa app that pertains to his relations with anyone in the US and as soon as he mentions you, it's a wrap. *sigh*

The rules for adjudication on a K-1 visa are different for a tourist visa.

When you study the rules for adjudication for the tourist visa, I think you'll find the answer.

Thank you for the replies i was just hoping his ties to nogeria would have been his job

and the fact he would have to go back to do his spousal interview and tie everything up

before moving here if approved thank you

Returning for an interview is not at all a strong tie but the total opposite. And a job in Nigeria would probably haredly convince a CO they would return. Usually having spouse, kids and alot of money in bank is what convinces.

Thanks dhwheels the problem we are having is I Only get 2

Weeks vacation and im using that to go to Nigeria in Feb while we

wait for admin processing ordeal over with which can take forever from what

Now you said you are denied and in AP. Which one is it?

Was a 221g given at interview? what did it say?

Are they doing further investigation or did they say they are returning your petition to USCIS?

dwheels, my husband and I once explored all the visa free countries we could possibly go to while we awaited the visa. Barbados was the best of the 'best'? lol....HOWEVER, the obstacle we ran into was that there is no direct flight to Barbados. Every flight had to go either thru the US or UK, etc. and a transit visa was required for those countries. We asked around on different forums and we were very discouraged to find out how hard transit visas were to get for Nigerian cititzens. I almost tried to talk him into Kosovo (the cold weather appealed to me since I'm a North East girl) but the look he gave me when I suggested it was enough to shut that thought down. The list is limited, but if you know anything about transit visas for Nigerians, please enlighten!

It said something like cant issue your visa at this time couldnt prove bonafide

relationship petition being sent back for admin processing due to time limits

on k1 that our options are refile k1 or get married and file spousal.....we

think it was because we met in South Africa instead of me going to Nigeria

to meet his family it was the only thing he said the CO made extra comments

about besides the fact Im a cook/bartender ...she went as far to tell him I

dont make much money even tho i make $30,000 a year which is above there

guidelines so we are lost and dont really know what to do

When its olderwoman younger man K1's just won't fly in Nigeria. They want to see commitment. So do as they say marry. And hopefully this time next year you will be awaiting an interview or done.

Look at our own Gowon how that man move chop chop and married filed and now home in US with his Empress.

And you know especially for Nigeria meeting the Family is of utmost important very few get approved not meeting the family. I have heard that some CO's look at beneficiaries not living in their country and interviewing a way to circumvent (Hide things like other wife, kids stuff like that) so they really want you to meet family, friends, neighbors.

Thank you again that makes alot more sense to me now....Solomon has been on me to just move to Nigeria while we go thru this process he understands that will be hard for me since I have 2 sons and a granddaughter here...if the granddaughter was older it wouldnt be such an issue for me....We thought about legally getting married in South Africa when we were there but I was told it would be a sign of desperation and we would be denied and this was by a lawyer...So we had a life commitment ceremony which isnt a legal wedding....So while we are waiting admin processing and the FOIA I filed for the COs notes I will go to Nigeria and have a great time to treasure...

oh yeah is there a difference if your file gets sent to NVC for admin processing or USCIS....I was told by NVC my file was staying there and then I read they get sent to USCIS....I havent gotten any notices for anything...just a copy of the 221g...its been 2 months this week
