My visa was denied yesterday,to me,I think is because of the red flags involve and is like the decision has been made before I got there,just they want to hear what I need to say,because all the question ask of me are all answered and simple that I thought it should be,This is really bad for me and my wife,well we just need to accept the faith.

I was given a paper written on it that it is pending and will be sent back to nvc and they will get back to my wife after the review is completed,please what can I do,really I don't really want to go to usa,but my wife insist,because of medical and some amenities she can't get here in nigeria and going to another country is like starting a new life for her which is going to be difficult. Please tell me what we need to do

So sorry for yesterday disappointment... Guess that how God want it.. You said something about the RED Flag... People here cant advice you without knowing the basis for the red flag.. Am sure you know that and with what you wrote, it quite clear you knew why your petition was denied.

Med care: been in Nigeria and am sure your wife will get total medcare!! All you have to do is to convince her and take full responsibility. Getting a Job might be hard but am sure she will( as long as shes educated) or better-still, she need to shuttle US-NG..

Yes, those are some serious red flags, especially in Nigeria. How often did she visit and for how long? Do your respective families agree with the marriage? Did you front load the file by sending in lots of bonafide evidence with the initial I-130 submission?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sorry about the denial, those are some serious red flag especially the age difference. If you were that much older than her it would have made a lot of difference. Unfortunately Nigeria is know as one of the highest immigration fraud country. Try to see if your wife can appeal through her congressman or involve a good immigration lawyer that can fight the case.

I am so sorry to hear about this. Lagos was on a roll. Would you please list the your evidence you submitted. You say you front-loaded.

What did you submit?

Can you list the questions you said they seem to focus on?

Seems whatever evidence that was sent in they weren't convinced. And honestly you saying you don't even want to come to the US they may know that to and well granting you what you want.

Was you not wanting to come to US mentioned in your evidence submitted?

Honestly speaking your red flags is really no issue. I know quite a few older women/younger men marriages who flew through interview age was never even brought up or an issue.

I would say something submitted didn't sit well with the CO.

Your case will be sent back to USCIS for wither a Notice to revoke or Notice to deny or a straight reaffirm.

here is the timeline. Between now and 9 months your case will go back to USCIS and you will get notice of them making a decision on your case.

The 221g they gave you did it ask you for any documents or just said you will be sent back to USCIS? If so that is a straight denial.

This is where you are getting confusing. First you say you are denied and they say they are sending your petition back. Now you say they are reviewing your petition. Which would mean you are in AP.

You need to know specially what it is they are doing with your petition. Denied as I stated above you will be sent back and you are looking at 6 months to 9 months hearing anything than acting on it.

So what exactly does the form they handed you say?

This is what is on the paper they gave me

This office regret to inform you that it is unable to issue a visa to you because you have failed to convince the consular officer that your relationship with the petitioner is bonafide.your case will remain pending under section 221 g of the immigration and nationality act while it is returned to the NVC for their review.when their review is completed,they will contact the petitioner who will then have the oppotunity to respond, if the case is reaffirmed,we will contact you to set up a new appointment date,if the case is not reaffirmed,the petitioner will be notified and the national visa center will close the case

Though we say here on VJ someone was denied, technically a CO can not deny but only refuse a case

and return it to USCIS via NVC with recommendation to review or revoke.

It sounds from what you wrote that the visa was refused and the case returned.

Your wife will be notified within 4-6 months + with a letter from USCIS.

The petitioner then has the chance to overcome the issue they mention with appropriate evidence as a rebuttal.

Sometimes you will not receive a letter and USCIS will look at the case and the CO's notes and then return

it back to the consulate with recommendation to approve.

Your wife can contact her senator and he can let USCIS and the consulate know that he is aware of this case

and perhaps get a bit more clarification for you.

All is not lost, you have time to rebut and a chance to overcome the obstacle.

Right now it is for you to figure out what they didn't like.

You say you don't want to come to the USA but you applied 4 times for a B2 and student visa.

When did you apply ? Before or after you met your wife ?

It would also be helpful to scan and post the 221g letter here with your name and case number crossed out

so we can see exactly what it says.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Import thing to do while the interview is fresh in your mind. Write down every detail of the day from your arrival at the consulate. Write down what you did , what was said , what the officer did and said. ( did she look at things during the interview or step away to speak to anyone ) Write in as much detail as you remember.

Go through this several times and see where you can pinpoint the negative points are these are the things you want to counter to start with.

Also go through weak points of your petition and prepare defense of petition.

Denials aren't the end of the world just a bump in the road. We were denied years ago and now have passed the citizenship hurdle

This will not be over quickly. You will not enjoy this.
