    I translated the birth certificate for my wife, when we were applying for the AOS, and no questions whatsoever. The good thing I speak fluently 5 languages, so it is not a problem.

    It's unlikely you will be able to extend your nonimmigrant B-2 status by filing the I-539. The burden of proof on these is very high, and by your own admission you have been substantially present in the US within the past year. If USCIS deem your extension request as "frivolous" then you begin to accrue illegal presence as soon as your I-94 expires. If they do not deem your I-539 as "frivolous" but reject it, then you begin to accrue unlawful presence as of the date the I-539 is denied.
    USCIS may believe you are attempting to live in the US on a tourist visa, which is not permitted. What is the total amount of time you have been present in the US within the last 12 months (all trips, added together)? If it's over six months, or if the extension request, if granted, would put you over six months, then it's very unlikely your extension would be approved.

    You have no greencard and yes she can withdraw her support and you have no means to legally stay. You said your I-94 expires next month. To protect your ability to come back again on the visitor visa you MUST leave before your I-94 expire. This will mean you will be able to visit your child.
    Depending on her state laws, the divorce may take some time to finalise. You can either file in the US, or when you return to your home country. She may also ask for child support after she's given birth.
    As to the loan, $25K... where exactly did you, a tourist, get a loan for $25,000?? Are you sure you don't mean $2500? As in 2 thousand, five hundred? You could try and get her to pay the money back but the loan people still see you as the debtor. You will be the one they come after for repayment. If you tried suing her she could always just file bankruptcy and never pay you back.

    Darnell and I have both contributed to a thread where pretty much the same questions have been asked now as were asked by the same person 6 months ago.
    That happens quite frequently and is even more annoying.

    If your wife becomes a US Citizen then she can petition them in F3 category.

    I think you are confused. The I-134 is required for the K-1. The I-864 is not needed until the AOS in the USA.
    The interviewers go by the guides and income levels of the 864 instructions for the I-134.

    We sent pics of our trip there n here.. and pics with each others family's. . Only sent 10..
    I sent text files from whatsapp. It was super long so only sent what would fit on one page.. for each month.. at time it was 13 pages max..
    Did same for skype logs.. 13 max.. felt it was important to shows months covered. .
    Didnt send emails.. but instead printed out the inbox listing of our hotmails.. hers and mine.
    We sti had our boarding passes. Confirmation of plane tickets that matched boarding passes.. and passport stamps..
    No phone logs.. since all was thru skype
    Total pack was 160.. ps. Make a copy of all before sending

    The k1 visa is a lot of time and work.. for nothing..

    wow.. you posted this same topic in November 2012..
    its almost like k1 was used to bring a person in on purpose for her to stay and not get married at all..
    for the purpose of just to get into the usa..
    its kind of has a tint of visa fraud..
    sorry.. but i at least i ain't USCIS.. :)
