If they cashed the check then the NOA1 is on its way, don't worry.
    Did you send the G-1145?

    1. No you must apply for it at the social security office
    2. You can apply for it a) within your first 90 days of arrival on a k-1, b) when you get the EAD, or c) when you get the green card
    3. You can apply for the work permit (form I-765) when you apply for the green card (form I-485). Generally the work permit will take around 60 days to arrive. It will allow you to work while waiting for the green card, which can take up to a year. It is free to apply for the work permit when you apply with the green card application. You should also file for advance parole (I-131) at the same time. That way you get a combo card (work permit/AP) which will allow you to both work and travel outside the US while you are waiting for the green card.
    4. There are no papers to file for a name change when you are simply taking your husband's name. You just use the marriage certificate as proof of name change. There is nothing else you have to do.

I think they are K-1, not IR-1/CR-1, since this is the K-1 forum. If K-1, that's a no to the immigration fee, and no automatic green card.
OP, what visa are you applying for?

K-1 visa holders never pay the $165 immigrant fee. They pay the adjustment of status fee instead. $985 for adjustment of status plus $85 for biometrics.

Yes you can use a co-sponsor if necessary.
No you can't marry her while waiting for the K-1. If you do that you would have to start again with the CR-1 process.

You are going by your married name now. That means you will go by that name for everything from now on, such as at the bank, doctor, ID/drivers license, etc. You use your new married name on ALL the AOS forms, and put your maiden name only where the forms ask for other names used.

Nothing. It's a souvenir. It's not needed now that you have your GC.

You need to cancel the first check ASAP. USCIS is part of Department of Homeland Security. Many others have made this mistake before and the check has been cashed. So they could still cash the first check.

Where in Europe are you? I know in London, proof of domicile is presented with the I-134 at the interview, rather than in advance with the petition.
Evidence usually includes things like getting a job offer in the US, a lease on somewhere to live, opening bank accounts, getting drivers licence etc. It'll be more than just a passport and a promise.

If you marry before then end of the year you have the option to declare yourself a resident for tax purposes, regardless of what any other residency test tells you. That way you can file as married-filed jointly and get the tax benefits. You need to include the declaration when you file.

She can't get an I-551 stamp since she hasn't been approved for her green card yet. It is possible to apply for emergency AP though. However there is still plenty of time to apply for and receive the regular AP.

If you only sent the W-2s, then that is the problem and why you got an RFE for the tax return, It must be complete, not just the W-2.

She may get an interview waiver. But current waiting times are up to a year for the green card for people who get an interview waiver. If she gets an interview, it's a lot faster to get the green card.

She already applied for the green card with the I-485. Now she just waits. She may get an interview appointment, or she may be approved without interview.

As others have stated here, the I-94 alone does NOT allow you to work during the 90-day period. You would need to apply for and receive an EAD as well. It is possible to apply for an EAD as soon as you arrive (costs $380 when applying before the marriage and AOS) that allows the K-1 visa holder to work during this period, however it takes approximately 60-90 days to be approved, and expires when the I-94 expires, so in practice it is a waste of time and money, because the visa holder would only be able to work for a very short period, if at all.
The best plan, if the K-1 visa holder wants to start work soon, is to get married as fast as possible and apply for AOS and EAD at the same time. The EAD application is free if it is submitted with or after the AOS. This EAD also takes 60-90 days.

Although not necessary, you should get a SSN while you can, within your initial 90 days. It will make your life easier. If you don't get it within the first 90 days you will have to wait until you receive your EAD or GC.
I think you mean your 90 days expires on January 7th, not your K-1 visa. Your K-1 visa expired when you entered. The expiration date printed on the K-1 visa is now irrelevant.

It's not worth applying for. You can apply as soon as you arrive on the K-1 with the I-765 and pay the fee but it takes up to 90 days to be processed, and since it expires 90 days after your arrival date, at best you will be able to work with it for a week or two.
Better to get married ASAP, then file the I-765 for free with the I-485.

Through the whole visa process i prepared all the forms and my husband just signed where I told him too. Why would that be a problem? Besides how would they know? Unless you fill the part about someone else filling it for you.
