Hey guys! My fiance's K1 visa was approved on December third! We are currently waiting for his passport to be mailed back to him so we can hurry and book his flight! But I have a question and I cannot find an answer anywhere!

Do we need to pay the $165 Immigrant Fee? It's so confusing with the K1 visa being processed so similarly to an immigrant visa even though it's actually a non-immigrant visa. Please help! And thank you!

NO....The K-1 visa is not an immigrant visa. The only fee due was the $240 visa fee paid to the US Embassy

When the K-1 files to adjust status, then you pay the $165 for the green card.

Well in that case, can somebody explain this. I was going to pay the Immigration Fee when I receive my K1 Visa. Or can it be done both ways, pay before or pay when the AOS paperwork is done? Cheers smile.png

From my understanding, the $165 IS for the Greencard so I figure that if the $165 is paid before leaving for the US the sooner we will receive our Greencard.

A K-1 isn't an immigrant visa, therefore the $165 immigrant visa fee does not apply to a K-1.

No. You do not need to pay it.

The $165 is for a green card.

The K-1 is a non-immigrant visa so you do not need to pay the fee. When the K-1 files to adjust status, then you pay the $165 for the green card.

K-1 visa holders never pay the $165 immigrant fee. They pay the adjustment of status fee instead. $985 for adjustment of status plus $85 for biometrics.
