My wife (US citizen) and I live in the UK and are we are applying for my CR-1 visa, and have just had our I-130 approved, and preparing to complete the next stage. My wife has been applying for jobs in the US to enable her to move ahead of me to show income and domicile. We wondered if anyone has had experience in using their assets to meet the affidavit of support requirement. We will have no US income to show, and are hoping we can use our savings, investments, home, retirement fund (assets we can convert to cash in a year) to meet this requirement. The guidance online talks of needing to have three times the difference between income and the poverty guideline for our household (2 people), and we hope we can do this with just the assets.

Can this be done with just assets and does anyone have any experience of this?

Paris Embassy - Potential K1 Transfer from London

Hello!

I'm hoping someone can advise us about what to do.

My fianc is a dual UK and French citizen. He resides in the UK, and our current embassy is London. The backlog at London is huge (easily 1500-2000+ cases based on historical data), and there's a new mandamus lawsuit being filed that we're considering joining, but we only just got our NOA2 and are worried we're not really going to see much movement in our case despite being a part of the lawsuit.

However, we recently learned that Paris seems to be transferring new cases from NVC to embassy only a few months after the NOA2 date. Have they basically cleared their backlog already?

Should we email to try to transfer our case to Paris? My fianc 's not technically a resident, but other members of his family live there, and we could theoretically use their addresses. Or should we continue with London and join the lawsuit?

My thoughts are if Paris has capacity and allows us to, we join the line there and potentially get an interview later this year which will also be one less case for London to process. But if that wouldn't work, I don't want to miss out on the opportunity to participate in the London lawsuit. Based on the lawyers' Q&A earlier today, they did encourage people to transfer cases if possible - another beneficiary was stuck at London but preferred Dublin due to having Irish citizenship. They said to go for it if there wasn't a backlog in Dublin.

Would appreciate any insight/advice, thanks!

Checking Case Status and what to do next

We are now at the NVC stage in the process and have contacted NVC for our case number and invoice number. When checking our case status on the NVC website it tells us to log into the CEAC website. So we input our case and invoice number where it asks and it states each time that it s invalid. We ve contacted the NVC twice to confirm the details they have provided us with are correct.

My question is: are we only able to log in at the embassy stage? Is this why we re having problems?

Any advice would be great.

So my in laws are approved and are trying decide what s next. How long do they have to come over with their packet? Once they get here and receive their permanent resident card how often can they travel abroad and what is a limit of how long they can stay abroad? They have a home and helpings they need to sell and another child that still lives in their home country. They want to be able to go back at least twice ( max 3 times) about 2-4 weeks during their first year of permanent residency. Is that too much time out of the us and they would risk abandoning their permanent residency?

Application N400 - "Have you EVER been arrested, cited, or detained"

Hey guys,

I'm applying for the N400 online today and I find the section asking about your criminal history to be incredibly vague.

The only interaction I have had with the Police since immigrating has been one non-moving traffic citation for not having an up to date vehicle inspection. But I'm not entirely sure how I am meant to answer yes/no on each question regarding this. I have listed the questions below and I have only answered yes to the one asking if I have been cited. The citation was resolved by paying the fine and I still have the court documentation showing that so sending in the evidence isn't a problem, I'm just not sure if my answers to all of the questions are correct. Could anyone help?

"Have you EVER committed, assisted in committing, or attempted to commit, a crime or offense for which you were NOT arrested?"

NO

"Have you EVER been arrested, cited, or detained by any law enforcement officer (including any immigration official or any official of the U.S. armed forces) for any reason?"

YES

"Have you EVER been charged with committing, attempting to commit, or assisting in committing a crime or offense?"

NO

"Have you EVER been convicted of a crime or offense?"

NO

"Have you EVER been placed in an alternative sentencing or a rehabilitative program (for example, diversion, deferred prosecution, withheld adjudication, deferred adjudication)?"

NO

"Have you EVER received a suspended sentence, been placed on probation, or been paroled?"

NO

"Have you EVER been in jail or prison?"

NO
