Hi friends,

My husband is a former K1 visa holder, and we actually just received his Green Card today!! (No interview was necessary! Such a great surprise. We live in NY for what it's worth. I know some states care more about interviews than others).

Anyway!

My biggest question is with regards to his social security number...

We applied for one on the basis of his K1 visa status last year... and we never got it.

We asked for it again when we submitted his Employment authorization document, which we sent in connection with his I-485 and the Advance Parole application... and we still haven't heard anything about the EAD or AP..

While we're very grateful to have the green card, I have to ask, what on earth is going on? Why didn't we hear anything about the EAD before the Green Card was processed? And do we go back to SSA with a new application? Anyone have a similar experience? Were you able to resolve it in any way?

Hello. We are filling out our ESTA for my wife to come to the US. I am a US citizen and resident in Spain. She is a Spanish citizen ex resident of the US.

We applied for a family resident visa with the 530 back when we were planning on living in the us and were accepted. Then we didn't move on with the process once it was referred to USCIS in 2019. We checked in using the website several times a year to keep it current, but eventually we must have started doing it wrong because we got a notice that over a year had passed since we had contacted them in October 2021. In April I sent a message formally withdrawing our petition but I have yet to hear back from them (backlog).

I feel like my wife should be eligible for the ESTA because she hasn't been denied a visa since the case is still open and our withdrawal hasn't been processed. am I missing something?

I am married to a Spanish citizen. We are still waiting for his interview date for the I-130 visa. I (US citizen) am working on filing taxes. I plan to attach from W-7 to get him a ITIN so that we can file as married, filing jointly. We want to claim the American Opportunity Tax credit because he took online classes in 2021 at a U.S. institution.

My question is, where do I put his foreign earned income (only about $7000 USD if you convert them from EUR) on form 1040?

This is a complicated question, but just curious if someone else has had the same issue/idea. Here are the details:

I (US citizen) am married to a Spanish citizen. We got married legally in Spain in 2020. We filed I-130 in September 2020. We are DQ'd at NVC, but awaiting interview date still.

My husband began taking online classes from a U.S. institution in Spring 2021, which cost ~$3000 USD.

He earned from working ~ 5,000 in the year 2021.

Question: If I file 2021 taxes as married, filing jointly, get him a TIN by filing form W-7, can I claim the American Opportunity Tax credit of $2500? How long does it take to file form W-7?
