Court declares DACA program illegal, but leaves policy intact for nearly 600,000 immigrant "Dreamers"

A federal appeals court on Wednesday said the Deferred Action for Childhood Arrivals (DACA) policy violates U.S. immigration law, dealing a blow to an Obama-era program that provides deportation protection and work permits to nearly 600,000 immigrant "Dreamers" who lack legal status.

A three-judge panel for the 5th Circuit Court of Appeals concluded the Obama administration did not have the legal authority to create DACA in 2012, affirming a July 2021 ruling from a federal judge in Texas who barred the Biden administration from enrolling new immigrants in the decade-old program.

Despite its conclusion, the appeals court did not order the Biden administration to shut down DACA completely or stop processing renewal applications, deciding instead to leave in place an order from U.S. Judge Andrew Hanen that left the policy intact for current beneficiaries. The government, however, will continue to be prohibited from approving first-time DACA applications.

My I129-F was granted, and her case was sent to the NVC, which then assigned it to the US embassy in Warsaw Poland.

We have not yet requested an interview date.

A few basic questions.

1. Where do I submit my I-134? This website says they are only accepting online applications for the Uniting for Ukraine program: https://my.uscis.gov/forms/declaration-of-financial-support/start/overview

Do I do it in USCIS or CEAC?

2. Speaking of CEAC do I need an "Invoice ID Number" ?

I cannot seem to locate one in any of the paperwork they have sent her. She has a profile here: https://cgifederal.secure.force.com/ and we paid the $265 to the US embassy in Warsaw.

Is this because she is getting a "non-immigrant" visa?

3. The DS-160, I assume she just goes here: https://ceac.state.gov/genniv/ and fills one out?

I'm confused. Can a Russian national technically enter Poland through a land border on the west, like Germany, with a valid Schengen visa?

And they will be turned away if they arrive by air from Germany?

Mongolia offered residency to any Russian willing to emigrate.

With ever-increasing difficulties of getting through Poland, with increasing I-129F processing times, how crazy would one be to have their fianc e make a pit stop in Ulaanbaatar for a year?
