Just wondering if folks have had experience or can comment on my situation. I've been working at the same company so far in my career post college, so stability and financial means are rock solid. But, from the eyes of USCIS, is it better to provide just last years transcript, or the last 3 years. My 'concern' is that in 2019/2020, I was married to my now ex-wife (divorce started in 2020 but only finalized early 2021) and filed jointly, in 2021 I filed single, and only got married again in 2022.

I was looking at the I-864EZ instructions, and my three questions are in bold below:

  • Part 5, Q4: Salary - I can get a salary letter from my company HR dept online. But, this letter shows base wage plus annual bonus - do I put the full amount, or only salary? (I think I do, since it's included on the salary letter?)
  • Part 5, Q5a: Yes - I have filed tax returns in the last three years.
  • Part 5, Q5b: Should I leave this unchecked, and not provide tax transcripts/returns for 2019/2020 when I was previously married? Just thinking I then need to provide my ex-wife's w2's and stuff from those years as well. But on the other hand, would it look strange that the numbers dropped in 2021 in the following question 6 (though, no where close to the minimum requirements.)?
  • Part 5, Q6a-c: Should I enter the amounts for 2019/2020, even if not providing the transcripts? (I think I should, per instructions)

I'm just hoping to provide the simplest and most concise view of my finances to NVC without pulling my ex-wife's stuff.

Does anyone here know what the current wait time is:

  • between Warsaw embassy receiving a spousal I-130 from NVC to sending the interview date
  • how long the wait time is for spousal interviews at Warsaw

We just got NOA2 approval from Vermont, so expect in the next few weeks to get NVC/CEAC info, fees paid, and docs uploaded... Hopefully DQ by end of the year. The tricky thing is for us - my wife has never had a Schengen visa, so as many in this forum know there is a big logistical problem for Russians going to Poland. It seems like Schengen visas are taking up to 6 weeks to issue, and appointment slots are not easy to get in a timely manner.

My thought on times is something like:

  • Early Nov - pay fee/upload docs at NVC
  • Early Jan - DQ'ed at NVC, case sent to embassy
  • Mid Jan - embassy receives case
  • Late Jan - embassy schedules interview
  • ??? - interview

But since Schengen interview spots are few and far between, I'm not sure if my wife does one of the following:

  1. look for a Schengen appointment with Spain/Germany/Greece/Italy asap, and then we just book a 'practice' trip in late Dec/NYE; and then hope that this visa is good for 1 year with multiple entry.... or
  2. try to 'guess' when the Warsaw interview would be, and try to get a Schengen visa appointment "just in time" for the Warsaw interview (early to mid Jan?)

Traveling outside US with pending I-751

We filed my wife's I-751 in September 2021 and she got a 2-year extension of her Green Card until November 2023. Next year we plan to spend five months in Latin America from February to July, so there is a high likelihood that the permanent GC won't arrive until we leave on the trip. We will have someone take care of our mail and have the online case tracker.

My questions:

1. If an interview is scheduled while we are away, how risky is it to ask to reschedule? Can you make a specific request for the new date, e.g. that it's after our planned return date? With 4 months between our return date and extended GC expiration, is that a sufficient window to have the rescheduled interview before the expiration date?

2. If the new card is issued and mailed while we are traveling (without an interview), does the old card still remain valid for re-entry?

Will relocation shorten GC time for USC spouse AOS?

Please help understand if relocation will shorten adjustment of status procedure for us.

Situation:

K&M.

K entered on B-1 visa 11/30/2021, Authorized stay until 5/29/2022

M is USC
K&M got married 5/8/2022 in good faith.
I-130/I-485/I-131/I-765 filed concurrently, receipt dated 5/27/2022
EAD received 7/13/2022

We specified San Francisco, CA as an office where we will go for an interview.

Timeline for I-130 for the California Service Center was 10.5 months, I-485 for San Francisco was 29.5 months.

Question 1:
- What processing time applies to us? I-130 or I-485? Or something in between?

Question 2:

What if M finds another job in San Diego, and M&K move to San Diego. Processing time for I-485 in San Diego is 13 months.

2.A. Will the case be transferred to San Diego office?
2.B. If it is transferred, will the 13 months time be counted from receipt date or from submission date?
2.C. Any additional complications we are not aware of?


Question 3:
M is able to get a position in his current company which would require 3 weeks in SD/ 1 weeks in SF per month. Obviously, the main place of living is SD. M&K move to San Diego, M will travel.

2.A. Will the case be transferred to San Diego office?
2.B. If it is transferred, will the 13 months time be counted from receipt date or from submission date?
2.C. Any additional complications we are not aware of?

I moved to the U.S. on K1 visa in 2019. Then I got my conditional green card in 2019 and 10-year green card in 2022. I am applying to the citizenship online and my application is based on the 3 years rule (marriage to the U.S. Citizen).

After reading the search results, I still feel like I would like to clarify one question.

Prior moving to the U.S. in 2019 I used to travel a lot, including coming to the U.S. in 2018 on B1/B2 visa; however, after moving here in 2019 I have never traveled outside of the U.S.

With that being said, how should I answer the question "Have you taken a trip outside of the United States in the last 5 years?". If I only count last 3 years since become LPR, my answer should be "No", but if I answer the question the way it was stated listing last 5 years, I have to include lots of trips including to the U.S. while I visited on B1/B2 visa?
