Just got a review note on my step-son's IR2 I-864 file. Seems the review officer only looked at my Adjusted Gross Income on my IRS Form 1040. The note claims my income is too low for my family size of four but will leave it up to the consular officer (Manila) to sort out. I tried to point out in the remarks of the I-864, that Social Security Benefits recipients, such as myself, don't get much of their SSA benefit taxed and that only the taxable amount is included in adjusted gross income for tax purposes. Am I missing something? Summary: My 1040 adjusted gross income was 30K, 32K is required. But, if you add up my two1099s (SSA and Army) you get 44K. I am fully retired. On top of this my fourth household member, a dual citizen son, age 17 gets his own SSA monthly benefit and its actually not a dependent for tax purposes. So I wrote a clarification letter to the Consular for my wife and step-son to carry on their interviews. Any words of wisdom??

We just finished our interview, and the consul said we need to submit I-944. Our application was postmarked before Feb 24, the day when supposedly the rule is in effect. As per USCIS website "Therefore, we will apply the public charge final rule and related guidance in the USCIS Policy Manual, Volumes 2, 8 and 12, to all applications and petitions postmarked (or submitted electronically) on or after Feb. 24, 2020. If you send your application or petition by commercial courier (for example, UPS, FedEx, or DHL), we will use the date on the courier receipt as the postmark date." I know I can just comply, but I think this is an error on the consul's part. We're just waiting for the notice, I'm planning to comply at the same time include the evidence that this shouldn't be applied to my application. Any inputs will be very much appreciated.
