IRS TAX RETURN REQUIRED ON I-129F PACKET OR NOT?

My fiance and I got engaged on May 31, 2022. We've been together for 3.5 years already. We are planning to apply for K-1 visa but we are not sure about the financial documents needed. My fiance is still in college but he was offered a full time work just this June 2022. His salary is above the poverty guideline for 2 person household. Although he did work for the same company for over a year already, he was working as an intern (salary still above the poverty guideline) which does is not considered as stable income. So, we are contemplating whether his recent income tax transcript is accepted or not?

Additionally, I have researched on numerous sites and testimonials as well as the USCIS site, whether tax return transcript should be included when submitting the I-129F packet. The USCIS website did not include the IRS tax return in the list of documents to be submitted with the I-129F packet. But some other articles says that it should be included. We are thinking we can apply for the Visa if the IRS tax return is required only on my interview date. Because by then, it will be after a few months or over a year and he will be able to file a recent tax return with his full time job. We are really confused about this, I hope someone can help me clarify this confusion. Thank you so much.

The first I looked at the USCIS website, I ran into DS 160. This is a form that is to be filled out by my fiance in the Philippines. She can hardly understand English. How is this done?

To answer my own question, the only way is for me to fill it out while she is online. Is this how it is done? Has anyone done this?

Hello,

So we are ready to begin the process of applying for a B2 visa, starting with the MRV payment.

1. The MRV fee deposit slip specifies the visa fee is valid for only one year. Book your appointments as early as possible.

yet..

2. The US website states that the appointment wait time for visitors visas at the Manila embassy is 409 calendar days.

Does #1 mean that we have up to a year to get online or call and schedule the appointment date. Or does it mean the actual appointment date also needs to be within a year from MRV payment?

In other words, if I pay the MRV on August 31, 2022 can I get online on August 30, 2023 and schedule an appointment for, say, October 2024 and be all good?

Or does the actual appointment need to be on a date before August 30, 2023 as well? If so, doesn t the 409 day wait make this impossible?

Second question: How far out is the current scheduling calendar (i.e. are we actually able to schedule an interview 409 days from now?)?

OK, my wife is leaving soon for Manila. One of our goals is to fix (Practically rebuild) her grandmother's house. She has the contractor lined up. Overall, she is going to want to travel with about $15,000 to cover everything.

Initially I was going to tell her to utilize travelers cheques, but it is my understanding that no banks will cash them now and the Amex office has horrific rates.

I'm a bit uncomfortable with her carrying that kind of cash (not to mention the forms it will trigger at the border).

Any suggestions? (The contractor won't take credit cards).

Is Marriage Certificate really needed for AOS I-485?

Hello all,

My Fianc and I got married here in Los Angeles last August 8. She came here in the U.S. under K-1 Visa in June 10. We are now looking into filing for Adjustment of Status for her Green Card. (Just an FYI, my wife changed her last name to mine)

The process for Marriage Certificate here in Los Angeles takes about 6-8 weeks (probably longer). I have done some research here and other websites saying that a Marriage Certificate is really needed for filing AOS. I have consulted Visa services and immigration lawyers and they all mentioned that we can file now without the Marriage Certificate and just submit my my Customer Copy of Marriage License that I got from getting the Marriage License form and signed by the Officiant of my Wedding.


I have read the I-485 instructions and on Page 9 it is stated:
"If you are unable to submit the required primary evidence (for example, a birth certificate or marriage certificate), you may provide secondary evidence (for example, church or school records) instead if you can explain why the primary evidence is unavailable. If you are unable to submit secondary evidence, you may submit two or more affidavits, sworn to or affirmed by individuals who are not parties to the immigration benefit sought and who have direct personal knowledge of the event and circumstances. You must also explain why primary and secondary evidence are unavailable."

So now, I am confused. for my understanding right now, Marriage Certificate is required as a primary evidence, but I can submit a secondary evidence such as my Customer Copy of Marriage License along with photos, and records from the officiant?

Also, my wife's I-94 is about the expire on Sept 7. Is there any difference on filing AOS between unexpired and expired I-94? and if my wifes I-94 expired, Is she still ok to stay here in the U.S?

When you receive and RFE, is the delay really that long even if you have the evidence and sent to USCIS right away?

Just to let you guys know that the reason why we are a bit rushing is that my wife I-94 is about to expire, she would like to work right away and to also get a SSN to be able to acquire drivers license.


Just seeking some clarifications on this and If anyone here has filed for AOS and had or have the same situation now. I thank you all in advance.
