Background: - Canadian citizen
- Granted a 6-month stay in the U.S.
- Overstayed by 1 month and 3 weeks
- Received a Withdrawal of Application by an immigration officer without case number or court orders.
I'm a Canadian citizen who was granted a 6-month stay in the U.S. Unfortunately, I overstayed by 1 month and 3 weeks. In september of 2023, I received a Withdrawal of Application by an immigration officer, who assured me that there wouldn't be any consequences later on and treated it more as a verbal warning. They advised me to return once I had stronger ties to Canada and a return ticket in hand. I'm currently in the process of a K1 visa application and am concerned about potential implications during the future K1 interview. I'm uncertain about the timeline for a safe return to the U.S and I'm aware that there is no specific timeframe set for when I can go back. My plan is to return to the U.S. for a short visit of 2 weeks to celebrate holidays with FIL and celebrate our engagement since we haven't been able to yet. I will have a return ticket, and will be able to show strong ties to Canada (employment, housing, bank statements, etc). I appreciate any guidance or information you can share.

I have seen some posts about this topic but don't know how to find it. I would appreciate it if anyone could help me. My CEAC status was updated yesterday, but it is still set as "refused." I had to send our passports with supporting documents, so I'm unsure what it means now. Thanks,

I crossed the border in June and got married in June, then I got my biometrics done in September. Just this week I got an ID card in the mail that says "Permanent Resident", is green, and looks like other cards I see on Google Images when I search "US green card". But I'm confused. First, the USCIS website says processing times for the field office near me are several multiples longer than the time I've waited. But more importantly, I haven't even gone to the interview yet. Am I misunderstanding what card I got? Did I get it in error? Is there an additional card I'll get after the interview? Am I still considered in the AOS stage? What are the limitations on me at this time (e.g., can I work? Can I travel outside the US?) Much appreciated!

My wife's 130 finally got approved just on the 11-month mark, huarry! Now we have a couple of questions that need some guidance since her case is kinda unique. 1, We know that it may take some time for USCIS to send the file to NVC, how long has that been so far? Right now it still says "approved", when will it say "Case Was Sent To The Department of State" roughly? Weeks? Months? 2, Once established, NVC sends a welcome letter, do we send all files electronically via the system or by paper? 3, Since she's from Hong Kong, we are thinking about changing the interview location from Montreal to Hong Kong, is that feasible? Because the police certificate in Hong Kong is unique and cannot be obtained w/o an official letter from NVC, we are thinking of getting everything done in HK instead of Canada since HK has less population on immigrant visa applications than Canada overall thus it may be faster. Thanks!

Hey everyone, this might be in the wrong forum but I wanted some info on the following: My Fiance will be coming to the US soon (221g at interview but passport sent to Montreal Consulate. hoping for an approval soon), and has been in open communication with his work about the process. Long story short- his initial plan was to "quit", move to the states on the K1 visa, and then hire on at the same company after applying for, and receiveing an EAD. (Company is in Canada and the US.) HOWEVER, his company has now offered to keep him employed and sponser a work visa so he can work here as soon as he arrives. I am worried this will effect the K1 process but maybe I am over thinking it. Should he "quit" his job, move down on K1 visa and wait for an EAD like everyone else, OR is it okay for him to be sponsered by his company simultaneously with the K1. Thank you in advance for your replies! I am not willing to risk messing up this process after waiting 2+ years.
