My wife has been documentarily qualified for about 3 months now. How long does it take until she gets an interview date? We are doing the Spousal visa by the way.

Renewing Passports

I'm a Canadian citizen awaiting my interview letter from the Montreal embassy. We are in the F3 category and DQ. My passport expires in end of February 2021. Just curious what the best course of action would be? I spoke with the passport office and they told me once I get my interview letter and date, I could expedite my renewal for my passport. Is this fine? Should I bring the new and old passport to the interview, and will I need to inform NVC before I renew it?

FYI - case is not current yet. 2021's visa bulletin says July 8th 2008 for January, and our PD is end of July, 2008.

Thank you in advance

RFE for I-130A - needing help interpreting?

Hi! So we received an RFE as apparently we are missing pages 3-6 & 5-6 on our I-130A. I was thinking they were saying I m missing the 3rd & 5th pages from the I-130A (which is super strange..) but not 100% certain if that s how it s interpreted. RFEs apparently have the ability mess your confidence and have you overthink!

Also, on topic of the I-130A, I am having troubles organizing my additional info on my 5 year employment history. I was told that I should do it chronological so I don t show any gaps of time. However I ve been in university for the past five years, and have had seasonal work to fill up the rest of my time - for example, I ve returned to work for a employer 3 for 5 winters and another employer for 2 summers. Do I repeat the info of employer 3 five times then? Or do I just put the info required for employer 3 once and list all the months employed? I also at the end of listing all my employers put:

reason for sporadic and non full time work:

Studied full-time from September 2015-April 2020 for my Bachelors of Science in Nursing degree at the _______university________ in ____city____, _____province______

would this be helpful or am I overthinking? Thank you in advance!

Help Needed for Green Card for mother thru consulate, at NVC level

Hello all,

I am helping my sister in-law that filed a petition for her mother that lives overseas.

Here is the background, the petition was filed in May 2019 and was approved in August 2020.

My sister in law was trying to use an attorney but the fees are too expensive so she asked for my help and I have a few questions please, this process is new to me.

She received the welcome email from NVC, titled "Notice of Immigrant Visa Case Creation" in August 2020 telling her to log on in CEAC, and follow the 12 steps.

So normally the next steps should be to pay the fees.

But when she gets to the website, there is a message that says: "Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time. The National Visa Center (NVC) will retain the petition until an immigrant visa becomes available. The NVC will notify the petitioner, principal applicant, or attorney of record when this petition is eligible for further processing. The principal applicant should not make any firm plans such as disposing of property, giving up jobs, or making travel arrangements at this time."

Please correct me if I am wrong: I thought for parents of US citizens visas were available at all times? Or does it have anything to do with the presidential order from April 2020?

But when I am looking on the forum I see that other people that got petitions approved after August 2020 were able to pay for the fees at NVC and move forward with their application.

Can somebody please help me and shed some light for me please?

Please see a screenshot of the CEAC session attached. I am also surprised that the name of the applicant is not even visible in the CEAC session.

Should she contact NVC and see why she is not able to pay the fees yet, 4 months after the petition was approved?

FYI the consulate will be in Burkina Faso

Thank you for your help

Importing BMW Motorcycle into the US from Canada

Hello!

I'm looking for some advice regarding importing my vehicle into the US. I'm being proactive about this so that I'm ready once the Consulate in Montreal issue me my visa.

So I have a BMW 2008 F650GS that was sold in Canada and I'd like to bring this with me when I move to the US. However, BMW have not been exactly helpful with this process. BMW Motorrad have flat out refused to issue any export/import documentation for their vehicles as a matter of policy. For the NHTSA requirements, this isn't such a problem as I can get a Registered Importer sort that part out. But the big hurdle is the EPA requirements. The RI has informed me that without a Certificate of Compliance or EPA emissions label, they cannot help me import the vehicle at all unless I go via an ICI, which is exceedingly expensive, plus no local ones in Blaine.

I'm wondering however if I can use Code 'M' on the EPA form to exempt it from the requirements, so that it only needs to be brought into compliance with the NHTSA.

By my reading of this, that anyone with a permanent Canadian Immigration status (i.e. Citizen or PR) is eligible to have the EPA requirements waived for the purposes of importation if they are permanently taking up residence in the US. Has anyone had success utilizing this exemption? And yes, I know that it would be easier to sell my Cdn bike and buy one in the US, but for sentimental reasons, I don't wish to do that.

Thanks,

CanadaDude
