So I DQ September 2019 and finally have my interview in November...I was just looking on the embassy checklist and found a curveball...form i864a....

On the website of the consulate it says the following...f you previously submitted to NVC an I-864 affidavit of support (AOS) completed by a joint sponsor (not the petitioner): Bring proof of the joint sponsor s legal status in the United States (photocopy of a U.S. passport, birth certificate, naturalization certificate, or legal permanent resident card) and their federal U.S. tax return (Form 1040) from the previous year. ((If the joint sponsor s tax return includes a spouse, then the spouse must complete Form I-864A.))

So my sister is my joint sponsor and she has a joint tax return with the spouse..but her income alone meets the income requirements...so in the uscis form i864a instructions it says only to submit this form if the joint sponsor income alone doesn't meet the requirements...and on the consulate website it says f the joint sponsor s tax return includes a spouse, then the spouse must complete Form I-864A.))

So Im confused do i need the spouse to fill this form and should I bring it to interview or not or not? (NVC never asked for it when I was submitting docs I just saw this first time today).

Not on named on lease or utilities bills - problem for N-400?

Hello! I joined my husband in the US on a spousal green card earlier this year. I left the US once for 2 weeks since then. It never occurred to me that when it became time to naturalize, I would need to prove continuous residence in the US. While I have my own US credit card I'm named on and a US bank account, I am not named on my husband's and my lease, internet, or utilities bill. This is because my husband had already set all these up before I joined him. I am not even listed on a cellphone bill, because I joined my husband's family's plan. I am not yet employed but expect to be soon (with a US-based company, of course), however, when my husband and I have children I expect to be a stay-at-home mom for a few years. So I'd imagine by then I'll only be able to provide a year or so of proof of employment in the US.

Is all of this going to be a problem for me for the N-400 in 3 years?

Previous addresses unknown

We just got our NOA and are filling out the next steps with the online paperwork. I'm (beneficiary) running into a problem with the prior address part. It wants all the addresses and dates I lived there since I was 16 years old. This is literally 30 years ago and between the ages of 16 and 21 I moved several times. I can't even remember the street names never mind the physical addresses and I definitely have no idea of the dates I lived at each specific address. I'm kind of stumped on how to proceed with this as it will not let me continue filling out the online forms until I fill in addresses to match the dates back to when I was 16.

Has anyone else had to deal with this and what did you do? Any help is appreciated!

After DS-160

Hi

My Fianc and I just received a noticed.

"NVC will now forward the petition to the U.S. Embassy or Consulate in Montreal, Canada. Please note that the transfer process can take several weeks.

The U.S. Embassy or Consulate will contact your fianc (e)/spouse when they are ready to process his or her petition"

Also states "next" step is to fill out the DS-160 online. My question is, so do I the beneficiary after completing the DS-160 have to start gathering information, and or making appointments for the medical exam/vaccinations?

Im not sure what the current time from notice from nvm to actual interview dates look like right now and I'm worried that by the time i get the interview my medical examination might be "out of date" due to the backlog that covid-19 has caused.

Also does the Consulate provide you with a interview date automatically or do I have to call the Consulate to schedule one.

Thanks.

EAD Expedite Tips with Congressional Support

This post is intended to help people who meet the Expedite criteria. PLEASE ONLY SEND EXPEDITE REQUEST IF YOU QUALIFY. I read people on reddit asking for expedite 3 -4 times after they have been denied. Do not waste USCIS s time because if you know you don t have a case to Expedite, you are just taking their precious resources that they could be using for people who TRULY qualify for Expedite. USCIS will ASK PROOF so DO NOT even try to expedite secretly hoping that USCIS will not ask for proof as they will just DENY your case. USCIS ASKS FOR PROOF.

https://www.uscis.gov/forms/filing-guidance/how-to-make-an-expedite-request

  1. Contact a member of your congress (house.gov for a Congressman or senate.gov for your Senator). Go to the chosen member of congress website and look for help with a federal agency
  2. Fill out the Privacy Release Form found on your member of congress website. This step is a must. The PRF form will explain to you why.
  3. Write a signed letter of hardship addressed to USCIS NBC explaining why it is important to expedite your case in as much detail as possible. For help writing a hardship letter, see this: https://www.kolkocasey.com/immigration-and-firm-news/how-do-i-write-a-hardship-letter
  4. You will also need to include any supporting documents that may assist in supporting your letter (USCIS needs a pending job offer letter that has an expiration date in an official letterhead). PROOF IS NEEDED. Do NOT expedite secretly hoping that USCIS will not ask for evidence. THEY WILL ASK FOR EVIDENCE.
  5. Fax or email your Privacy Release form, signed letter of hardship and proof of financial loss such as a pending job offer to your member of congress.
  6. Wait for a caseworker at your member of congress to contact you within 24 business hours. If you have not heard back from them, call them after 24 business hours telling them that you faxed the Privacy Release form, hardship letter and supporting documentation.
  7. You will be approved within 7 days if your caseworker is good and knows who to call. If you are not getting a good resolution with your first chosen member of congress, contact someone else after 7 days. My first caseworker at Sen Jacky Rosen s office in Nevada just kept sending emails to USCIS and I lost 3 weeks. After I got fed up with her, I contacted Sen. Catherine Cortez Masto s office and within 1 week I got the EAD approved. It is because the caseworker at Sen Masto s office actually picked up the PHONE and called instead of the other caseworker who likes to send email which USCIS likes to ignore.
  8. Do not contact multiple members of congress at the same time as if all of them are working on the same case, there is duplication of efforts and your case will be further delayed. The PRF form will ask you if you have contacted another member of congress and if you say yes, they will not help you (and you cannot lie as they will know).

IMPORTANT: I know everyone wants to get their EAD card sooner rather than later due to the current 9 month wait at the NBC. Many people who do not qualify also expedite since it is free. PLEASE ONLY EXPEDITE IF YOU QUALIFY PER THE USCIS CRITERIA and IF YOU HAVE PROOF TO BACK IT UP. USCIS asks for PROOF so do not even think about it does not hurt to ask . By asking for Expedite if you don t qualify, you are taking precious resources away to people that REALLY NEED IT. To be clear USCIS ASKS FOR PROOF.
