My mom has an interview date received today.

What original documents be presented from Petitioner's side.

I know the applicant's original documents to be presented but I am not sure on the petitioner side.

  • Affidavit of support the original one?
  • The Naturalization cert?
  • Birth Cert
  • Marriage Cert
  • old and current paystubs?
  • The Tax statement new and old?

Please advise. I am planning to send these originals by courier to her.

USPS delivered GC to wrong mailbox - I-90 question

Has anyone recently AND successfully filed an online I-90 with the fee waived after USPS misdelivered? If so what steps did you take to ensure this? We really do not want to pay the $455 fee if we can avoid it since money is tight and prefer to file online since it would be faster and easier. Our situation is explained below.

I live in a house where a second family rents from the first floor unit so we have 2 mailboxes, one for their family and and one for mine. After my I485 was approved, I received a tracking number. After some waiting, the tracking said it was delivered to a "PO box" with no number. We do not have a PO box. I called the USPS office that delivered it and the lady that answered the call said it was strange that the tracking says delivered to a PO box with no number and that it shouldn't happen. Turns out, she recalled that she was the one that delivered it and said she didn't know which mailbox it was (even though they're labeled - mine says 2F for floor 2, which is reflected in my address) so she put it in a random one - which turned out to be the incorrect one. We've never had past USCIS correspondence misdelivered before so I was confused. I spoke to the family downstairs about it and they don't have it/don't know any information about it. Basically, we have no idea where it is now. Maybe someone on the first floor took it and threw it out or lost it in their house. We cannot accuse them of anything. Ultimately, it is still USPS' fault for misdelivering it. Their usual postman was on holiday during the time they delivered it so the lady that filled in for him was from another office, unfamiliar with our mailboxes. I asked them to write me a statement or letter to confirm they delivered it to the wrong mailbox and they agreed. Waiting on that to be sent to me currently.

We called USCIS and asked what we should do. They told us to file a paper I-90 along with a fee waiver but I'm worried it will be denied. I also did some searching on this forum to compare other people's similar USPS experiences and it seems mixed. For example, these posts were able to get it successfully waived:

The first one was able to get it waived for free online but the second one seemed to have done the paper filing with a fee waiver form.

But there are also some failed experiences:

These are pretty old from 2015, 2017, 2019 so I really want to know if there are more recent cases where they were successful. Should I bite the bullet and pay the $455 lost/stolen option and attempt to file a fee waiver to be "safe" and get a stamp OR do I have good chances of filing online as "never received" since I will have the statement from USPS that they misdelivered?

Hi guys,

I know this is a common topic and it's something I've been considering recently, so I guess I just wanted some further insight.

My fianc and I are currently 6 months (July21 filers) into our i-129f, meaning we still have roughly another 10 months to go for our approval (Oct estimated approval).

I'm seeing that the wait time for for CR-1 Visa is roughly 10 months right now, so it's been on my mind about switching, so I can avoid the whole AOS.

Is the timeline really 10 months right now for a spousal, and are they all processed in California as well? Because when I check the processing times they're all roughly the same at all the service centers, with the exception of Vermont which is 16 months, and I would hate for mine to be sent there and have added even more time.

I-797 Approval NOA Date ends soon, Beneficiary waiting on Consulate

I filed for a I-129F in July 2021. On September 28 2022, I received NOA2 form I-797 saying it's "Valid From 09/28/2022 to 01/27/2023".

On December 20, 2022, I received an email notice from NVC saying they have forwarded the petition to the Canadian US Consulate in Montreal. However my partner is still waiting to receive the packet from the US Consulate via mail.

Do I need to file an extension on the I-797, since that date is in less than 3 weeks? If that date passes, does USCIS drop the case? I'm finding conflicting information, some saying that it's automatically extended, some saying that it doesn't matter as soon as the NVC processes the case, and both of us worried that we should try to extend it anyway. And I don't know the best way to do that.

Hello guys,

I just received an EAD and advance Parole for my wife who left without one. She left in January of 2022 when I was doing the AOS paperwork. USCIS sent me a letter in december 2022 to prove that we are still together. I cannot do that because she left me. I am in the process of reconciling with her. Does that mean she can be allowed in the country if I send her the EAD card through the mail or is that process completely dead and I should think of starting a spousal process. Any information would be appreciated.
