Hello everybody. I'm a US resident. I'm pregnant and my family wants to come over from Argentina to meet the kid. When they went to buy their flights they noticed that some family member's visa are expiring next year. They already submitted the application, but they got the interview scheduled for March 2023 (!!!!!!!) Anyway, I read over here that it's the regular timeline that we're looking at for tourist visas.

My questions are:

1- Is the expiration date considered the last day they can stay here? I mean, if they want to enter the country one week before it expires and then it expire while they are over here. Would that be an issue? could they get denied to enter the country if that's the case?

2- I'm searching information about the situations that are considered to approve an expedited appointment but I don't think the birth of a grandkid would be considered one. Any advice on that?

3- Can the fact that they already applied for a new visa while they still have a couple of months on this one, make their entry complicated or denied? I wonder if being already in a "new process" can cause any trouble coming in.

Although We are ~18 months away to be eligible for I-751 filing. What proactive things we should do to have a strong removal of conditions case? Other than, Joint taxes, utilities, rental agreement, Auto & health insurance what other things are often overlooked?

Our initial I-485 package was bleak just enough to get the application started. We scrambled for 2 weeks before the interview to gather all the docs, which was arduous and anxiety inducing. We want to run a slow marathon and start putting evidences together over the next two years. Any tips advice is highly appreciated.

Hello, we received an RFE that asks to resubmit the I-864 with evidence. The letter contains the following bullet points to be resubmitted:

You did not submit a properly completed and signed Form I-864, Affidavit of Support, for the petitioning sponsor listed on Form I-130 or Form I-129F. Even if a joint sponsor will be used, the petitioning sponsor must submit Form I-864. (Form I-134 is not acceptable for Adjustment of Status.) In order to process your

application further, you must:

  • Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor.
  • All pages must be present and of the latest edition date.
  • Provide the petitioning sponsor's Social Security Number on Form I-864.
  • Provide a complete and correctly calculated household size on Form I-864.
  • Submit a complete copy of the petitioning sponsor's Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.

I have carefully reviewed the I-864 multiple times and referred to both VJ and the I-864 instruction PDF.

  • Completed, signed, and submitted Form I-864 --> Done (in the initial and prospective submissions)
  • All pages must be present and of the latest edition date. --> Done (in the initial and prospective submissions)

Per USCIS website, Edition Date: 03/10/21. We will publish a new edition of this form soon. In the meantime, you may continue using the 03/10/21 edition despite the expiration date. You can find the edition date at the bottom of the page on the form and instructions.

  • Provide the petitioning sponsor's Social Security Number on Form I-864. --> Done (in the initial and prospective submissions)
  • Provide a complete and correctly calculated household size on Form I-864. --> Done (2 household size, it is me and my husband. Submitted 2 in the initial and prospective submissions)
  • Submit a complete copy of the petitioning sponsor's Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year. --> Done with small revisions. These include "unchecking" 23.b.; still listed Tax Year for 24.a.,24.b., and 24.c. as 2020, 2019, and 2018; and corrected the dollar amounts from Adjusted Gross Income to Total Income as I filed 1040.

Included:

2020 IRS Tax Transcript downloaded from the IRS website (previously submitted 2018, 2019, and 2020 IRS Tax Transcripts)

Latest employment verification letter that states my current annual salary (in the initial and prospective submissions)

2020 W-2 Statement (in the initial and prospective submissions. Previously submitted W-2 for 2018 and 2019)

4 months of pay stubs (in the initial and prospective submissions. going to submit the latest 4 months of pay stubs)

I am confused as to what needs to be fixed at this point. For all the years (2020 & 2019) I submitted tax info for, I have been over the 125% income threshold needed. For 2018, I was slightly under the (poverty) income threshold by $3K as I started my job in November 2018; I am not sure if this could have been the issue. If so, would it be recommended to explain in Page 10 Part 11 (Additional Information) of I-864 why my 2018 income was below and include my job offer letter that states my start date as November 2018?

I would appreciate if you could please give us some guidance to this. Thank you.

Somebody outside the US participating in a US conference

Hi there,

I have a very specific question and can t seem to find an answer . Hopefully somebody can chime in.

I work at a school in the US. My parents are in my home country. My dad is a specialist in a topic that my students are studying. If I ask him to participate in a virtual conference with my students in the US, would he be breaking any immigration laws?
FYI: this is not about me, I m a permanent resident. I just want to know if my dad or my employer would be breaking any laws by hosting this conference. Thanks!

Hello,

We hope this message finds you well.

My wife and I have received an RFE for AOS (I-485) requesting for "a copy of their birth certificate issued by the appropriate civil authority in their country of birth. We will only accept a long-form birth certificate which lists at least one parent."

My wife was born in a small, rural town in Argentina where it is still using an old-fashioned birth certificate that does not have the document name such as 'Acta de Nacimiento.' https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Argentina.html.

After reaching out to her birth place civil authority, we have been informed by them that there are no other birth certificate templates that can be created. Unlike those applicants who are from the capital city of Buenos Aires, my wife's birth certificate does not seem as official as theirs.

We have submitted the documents listed below and wanted to ask you if anyone had this experience and how you were able to move forward with your AOS.

>Copy of original birth certificate in Spanish

>Copy of legalized Additional Signature Sheet in Spanish

>Copy of apostille of original birth certificate from the Government of the Province of Buenos Aires
