I’m a citizen and our interview was on Feb of 2006 that day my husband also got his fingerprints done., On September 2006 we moved (but stayed in same borough) and immediately change our address online, completed and changed the address change form, changed our address at the post office. I check the case online almost everyday. We also call the costumer service # every other month and we had 2-3 infopass since then. The message is always the same “the case is pending at the processing site.”

Today we got a letter stamped for the day Oct 25 stating that 2 letters has been sent to informing us of appointments to go for fingerprinting and because he failed to go the application to change status was DENIED no chance to appeal :crying: . Also his Employment Authorization was canceled and if he did not file a motion to reconsider (which cost $585 dollars and one and a half year to approve) with in 30 days he would be deported  . We never received those letters. We have all this prove that we have been trying to find get information on the case, so how can we not go to the fingerprint appointments.

I talked to a lawyer and she said that it all seems as if it was their error, still there is nothing we can do but to file the motion to reconsider because immigration would still require it.

I cannot believe the incompetence of the USCIS  . I’m worry because my husband has been in this country for 10 years (6 years with the process) and he misses his parents so much, they are growing old and he wants to see them so badly. They are already telling him to give up and go back to Morocco but I’m an American woman, my family is here, and here is where I want to stay but with my husband. This is putting a strain on my marriage. I need help… Please :crying: .

IT is possible they mailed out those notices to old address somehow or did not get your new mailing address updated. Better call USCIS 800 number now and explain what is happening to you and tell them you have all this proof. And you may have to file that $585 just in case while working this whole thing out. Sorry for bad news.

You might want to try to make an infopass appointment and take your paperwork with you. It is possible an IO can reverse the decision, a friendly Congressional aid might be able to help as well.

But if they don't you will need to file an appeal or motions to reopen.

The most important thing is to have your paperwork filed in less than 30 days if the USCIS does not reverse itself.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Sorry, but calling the 800 number won't do anything in this case.

I suggest you get with a good immigration lawyer but maybe someone has some more and better information for you.

Good luck to you, this is really messed up but honestly, it doesn't surprise me, that they didn't get your change of adress right or for whatever reason you didn't recieve the appointment letters.

I hope, there is a fast and easy solution for this!!

There have been a few cases on VJ where people have had this problem because they moved and they were able to get the case re-opened. I'm not quite sure what they did to do that, but it is a fixable problem.

The 1800 line won't help much, most likely. Make an Infopass appointment, take your copies of your file with you, and they might be able to get this sorted out.

Agreed, Infopass is the best option, you can actually speak to a human being rather than a disembodied voice on the end of a telephone line who actually can't do diddly squat. Take all your documents pertaining to your case with you (USCIS letters etc) so you can go through it all with them.

Good luck!

But how is it that when I called the reps and went for infopass the mailed me the response to my new address. I called the costumer service # yesterday right after I got the letter and he told me that the address that they have in their system is the new and that it was updated when I put the change of address back in 2006. The fingerprint appointments were supposedly sent on February and May of 2007.

Did you only do the on-line AR-11 address change? Or did you also send in the sponsor I-865 address change notice? The I-865 address change notice is the ONLY form that will generate an NOA reply from USCIS, and will notify the district office to mail any further notices to the new address. The AR-11 does not do that.

And I think that even with INFOPASS being notified of your new address, that still won't take the place of the I-865.

Hi :) ! thanks for the response. we made the infopass for Tuesday of next week and we have all the copies that were sent when we requested information (about 10 of those). We also have copies of my previous infopass appointments. In addition, we have an interview to see my lawyer on Monday and we want to stop by our Rep. office.

My husband is has... had  an employment authorization and every so often he has to renew it. He's been getting letters from them and a couple of months ago they sent him for fingerprints for his employment authorization.

I'm a very emotional person, right now i'm experiencing a tick in my right eye since yesterday.

I will like to thank all of you for your help and support  . I really appreciated, its ironic that you've been more helpful than the reps. at the USCIS when they are the one getting a salary for doing a mediocre job.

We did the AR-11, which is what we got from the USCIS website. Now they have the option to change the address online but at the time that we moved last year that was not available. No information was given to us about another form. We checked online and call the reps. Form AR-11 was all we hard of.

Your advices continue to be very poor. I am surprised you didn't just say: "I will be denied !!"

And FYI, the 1800 number is a service which is provided by a thrid party company and they are known for giving wrong information all the time, they have access to nothing more than what you have access to. So that's very poor advice.

Hello to all,

Well, I took your advice (after waiting a week for immigration to send me a response) I managed to see a immigration specialist at my congressman's office. I explained the case to her, she saw the USCIS had made a series of error on our case. She immediately called someone at the USCIS and asked to see when they got our AR-11 form, the lady on the other side responded that they got the form on Oct-03-06. After a serious conversation about our case with the officer at the USCIS, she(immigration specialist) faxed a letter to them stating the following:

Pending i-485; this case was denied on 10/25/07 based on "No show" for Biometrics (see pert. info.) appt.: The Pet. and Bene. Submitted an AR-11 and was receipted on 10/03/06; The Biometrics were scheduled for 05/31/07 & 02/28/07 and sent to the old address listed; the FR prints expired on May 2007(see adit stamp from the old FR print appt. that was sent to the old address dated on 02/21/06; We are requesting on behalf of the Pet, & Bene. that a "service Motion" be reconsider base upon the findings that is stated above (AR-11); service motion; service motion;service motion: Please Advise.

As advised by the officer at our first infopass on Nov-06, we made another infopass for nov-20 to see what the an answer was to our inquires.

http://www.visajourney.com/forums/index.php?showtopic=94891

We went to the infopass yesterday and after checking on the case the first thing that she asked us was, If we had gone to our congressman. I responded yes  , we did. She then said that because we did that the case is being look into by somebody else in another department. She also checked the system further and she saw that the still had the old address in what she called "the old system", she then updated the "old system" so that when they finish reviewing the evidence, the decision would be sent to the new address (after all this they still had the old address in the system :ranting: ).

I asked her that by the time that they decided to reopen the case or not, it would be outside of the 30 days and if they decide not to reopen, can we still do the motion to consider. She said that it's being reviewed as a motion to reconsider. She said that we should be receiving something within the next couple of months  . Finally some good news  , that means we do not have to pay the $585 plus 1500 to our lawyer to do the motion to reconsider.

For now we are just waiting. I will keep you posted on the case. Thanks for the help guys (F) (F) (F) (F) (F) (F) (F) (F) (F) (F) (F) (F) .
