application DENIED moved but never got fingerprint appointment

I’m a citizen and our interview was on Feb of 2006 that day my husband also got his fingerprints done., On September 2006 we moved (but stayed in same borough) and immediately change our address online, completed and changed the address change form, changed our address at the post office. I check the case online almost everyday. We also call the costumer service # every other month and we had 2-3 infopass since then. The message is always the same “the case is pending at the processing site.”

Today we got a letter stamped for the day Oct 25 stating that 2 letters has been sent to informing us of appointments to go for fingerprinting and because he failed to go the application to change status was DENIED no chance to appeal :crying: . Also his Employment Authorization was canceled and if he did not file a motion to reconsider (which cost $585 dollars and one and a half year to approve) with in 30 days he would be deported :angry: . We never received those letters. We have all this prove that we have been trying to find get information on the case, so how can we not go to the fingerprint appointments.

I talked to a lawyer and she said that it all seems as if it was their error, still there is nothing we can do but to file the motion to reconsider because immigration would still require it.

I cannot believe the incompetence of the USCIS :angry: . I’m worry because my husband has been in this country for 10 years (6 years with the process) and he misses his parents so much, they are growing old and he wants to see them so badly. They are already telling him to give up and go back to Morocco but I’m an American woman, my family is here, and here is where I want to stay but with my husband. This is putting a strain on my marriage. I need help… Please :crying: .

IT is possible they mailed out those notices to old address somehow or did not get your new mailing address updated. Better call USCIS 800 number now and explain what is happening to you and tell them you have all this proof. And you may have to file that $585 just in case while working this whole thing out. Sorry for bad news.

Your advices continue to be very poor. I am surprised you didn't just say: "I will be denied !!"

And FYI, the 1800 number is a service which is provided by a thrid party company and they are known for giving wrong information all the time, they have access to nothing more than what you have access to. So that's very poor advice.

Really, did not know you worked for USCIS. By all means how come you did not share that with us all.

So nice to see someone who is sharing the wealth of his experience at doing AOS and dealing with USCIS...... just a shame is wrong......

I have read a post on here theat was denied, she pleaded hardship with the local office, and the repoened the case with no extra cost.

I feel Good...........like the moon is shining just for me!

:D Hello to everyone here at VJ,

Well its been a while since my last post, I was out on vacation. I will like to update you on our case. After we went to our congressman's office and a staffing specialist sent a letter asking them to do the service motion, the uscis decided to do the service motion and reopen the case :dance: . They sent 2 fingerprint appointment, sent him to a civil sergeant, and 2 appointment for another interview (different date) one for the 1st of Feb and another one for the 5th of Feb :wacko: .

We had to bring copies and original of the affidavit, lease, and so on once more. :rolleyes: We decided to go with our lawyer and it was a good thing to do because there was 2 immigration officer this time interviewing us :o . They said that because someone decided to do the service motion they wanted to make sure that it was not because they felt presure to do so by our congressman.

The interview was intense, they were asking lots of question :huh: . They asked my husband why he failed to show for the fingerprints, he explained to them that we had moved and that same month we sent the change of address form. She asked if we had copies of the AR-11 form because they had no record that we've ever sent it to them. I knew for a fact that they did received the AR-11 form because of the conversation that the immigration specialist had with an office at the USCIS but whatever -_- . In the end the told us they will review the case further and make a decision. They wrote pending in my husband passport and said that that was all. After all we have been through I was expecting the to stamp my husband passport right there but on the other hand at least they didn't denied it again.

Now we are praying and still waiting :clock: ....
