PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

1 RepliesMy Ugandan fiance is in Kenya. She was approved for K1 on March 12, and her three K2s already got their visas (Issued and picked up). However, her CEAC status still shows Approved after 2 weeks (with created and last updated date both being March 12). I inquired about her case via the contact that the embassy provides (VisitorVisaNairobi@state.gov), and I got this response:
QuoteWe have reviewed our records and learned that your nonimmigrant visa application is still undergoing administrative processing to verify your qualifications for this visa. Administrative processing often lasts about 90 days, but in some instances, it can take significantly longer.
I emailed them a second time to ensure this wasn't just a templated response and to get clarification since her case still shows Approved in CEAC (not Administrative Processing). Then they responded:
QuoteThe application is approved however, mandatory administrative processing was required in the case, and this is now being carried out. We have no control over this procedure and the length of time it requires. However, we have noted to contact you as soon as this procedure is concluded.So I'm looking for advice from anyone with experience:
Should she keep waiting in Kenya, or request the passport back so she can return to Uganda to wait from there? I'm concerned that requesting the passport back before the case is officially in Administrative Processing in CEAC may slow them down from being able to process and issue the visa. My understanding is that if it's Approved in CEAC, the next step is Issued and they cannot go to that step if we take the passport, right? Will they release the passport if it's going to take a long time in AP?(Side note for those who don't know: Kenya/Uganda are in an East African partnership where you can technically travel with just a National ID, not a passport. However, unfortunately, she came via her passport and, as far as I know from research, she cannot travel back using a different document than she came with.)
Maybe I can get a letter from the embassy explaining the situation and use a copy of her passport along with her National ID?
Any ideas?

I'm filling out the i-129f visa form online. My fianc currently resides in San Luis Rio Colorado; Sonora and I'm on the section where it's asking for my beneficiary's address abroad under City/Town.
- Would it be best to add his city name by hand in black ink? When I try to add the city name it's too long and ends up being one character short on the form.
- Do I have to add a Province? Is the Province the same as the State? Would it be Sonora?
- Are Zip Code and Postal Code the same?
- Do I fill out all sections as N/A if they're not applicable to me or him?
- It won't allow me to type his full number with the +52, would it also be best to write this by hand?
These are my main concerns at the moment as I'm planning on mailing it by this Monday.

I m in the process of filing a marriage-based green card and wanted to get some insight from others who ve been through this.
My spouse is the sponsor, and our household size is just 2 (no dependents). Based on the latest tax transcript:
Total income: ~$39,000
W-2 income: ~$37,800 (stable employment)
Small additional self-employment income
From what I understand, this is above the 125% poverty guideline for a household of 2, but I ve seen mixed experiences online.
Has anyone here successfully filed with a similar income level?
Did USCIS accept it without issues?
Were you asked for a joint sponsor anyway?
How important was current income vs tax return income in your case?
Any recent experiences or advice would really help. Thanks in advance!
