    PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
    When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
     
    Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

    Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
    I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

    Wrong USCIS application form filed by my lawyer!
    Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

    Seeking advice for Thai/US couple - What US visa path to take?
    My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time.     Hello everyone,

    I have a question. My spouse and I were living together since 2022 he arrived with K1 visa. We went for interview and got approved for 2yra now its time to apply for i751.. My only concern is last year june he got a job in another state. We have alot of bills, pictures and we had our big celebration of our vows with family and friends in January. I am about to mail the paper work in and I know i have to add our DL, this is a case where out addresses are not the same, what should I do? I have copies of the old DL with our addresses, should I include that and his current one showing that he iust changed his address this year or since we have enough evidence I shouldnt bother about it? We have car insurace, title, life insurance, health insurance from his work, pictures, bills, affidavit from friends

    Hello! It's been a while but we have finally received an email that our NVC is being sent from the US embassy to La Paz, Bolivia! Wooo!

    Well we checked on our case status online and it says:

    "Your case is ready for your interview when scheduled at the U.S. Consular section. If you have already scheduled an appointment for an interview, please prepare your documents as directed in your appointment letter and appear at the consulate on the appointed date and time. Otherwise, please wait until you have been notified of your interview appointment. Additional information about how Immigrant Visa interview appointments are scheduled can be found at: http://nvc.state.gov/interview"

    Just wanted to make sure that we will receive a following email of the appointment date from the Bolivia embassy? At this point, it is just waiting and collecting documents for the interview until we receive notification, right?

    This is my first post here, and I don't want to start a new thread on topics that have surely been covered many many times. Our March 2024 I-130 got approved in the past few days, and NVC received yesterday, and while this was our expected approval time, it still has been a lot to take in. This is because our feelings about settling together in the US have changed since when we applied, and we're now looking into/considering myself getting a spouse visa to the UK instead to live there together. Their actual visa processing timeframe is much faster than the US but it would take us some time before we're even eligible to apply because of the financial requirements, at least 6 months in the best case scenario. So it's not set in stone yet, but we're very interested in residing there instead. In the meantime though, it would be a shame to lose our progress on the US visa and have to start over, and ideal to keep the avenue open just in case we want/need to go through with my spouse coming here as originally planned. Of course if we did commit to applying for and obtained a visa for me in the UK I'd imagine we'd cancel the US visa application, but before then it's probably best to keep the options open.

    So I wanted to ask if anyone is able to explain or provide links to explanations of how much wiggle room there is at this stage. I've seen the basic info that if the NVC doesn't hear from you for a year, they will cancel your case. But what are the specifics of that, what kind of communication/action do they expect within that year mark, and how quickly, etc. Basically if we hold off on it a little bit, what are the risks, what will happen next, what's expected and how soon. I've also seen some mentions of people holding their cases at the NVC stage for quite some time, but not sure how that works. Make no mistake there is no intent of doubling up on visas at the same time and not using one or the other or playing out both sides, we just need time to assess. It's very hard being separated for over a year now (despite visits every few months and texting/calling every single day) and we of course want to be together over everything but the legal process on both sides is complicated, long, and expensive, we're both under 30 and don't have kids so the choice we make requires us to consider a whole lot about our futures, careers, starting a family down the line, connection to existing family, how we feel about the political/social/economic future of each country, etc, so there is a lot to take into consideration with where we want to end up. Currently we feel strongly about choosing the UK but it will be a bit before we're able to fully financially commit and we need to do more research, so are we at risk of losing progress on the US side if we keep things open while we work that out, and what kind of steps should we take at this point?

    I am a US citizen, I will turn 21 in another few months. I am currently studying in college. I would like to sponsor my father's greencard, he is currently in US and on L1B visa. My father is from India, but I read that there is no wait time for immediate relatives so I believe I can file i130 AND i485 together. Also, my father already have 40 work credits from social security, so I think I can be exempted from financial sponsorship evidences. Need guidance and support from experts in this group on my assumptions and the next steps. Thank you all for your help.

      Hey you OldUser:  Can you help remind me where on VisaJourney we can go an view applicants with similar Visa applications to get a real idea of where we stand in the line?  Or maybe it is easier to go somewhere on the USCIS website??   We applied for my Wife's adult brother some 12 years ago and originally we thought it was going to b a 20 year process....it sounds like it might be a much longer process putting in jeopardy his ability to bring his under 21 year old children along with his wife.   Thanks, Eric

      1. i am so confused between these two. the first one states I should include my husband’s current annual income and he got a higher annual income now since he got promoted to a new position in the company a week before our wedding.
       
      and the 2nd one shows his recent 2024 annual income and it’s a different amount from his previous position in the same company. is it ok if both amounts are different?
      2. hubby had jr in our petition but it was omitted on our marriage certificate, for i-864 and i-485 should we continue using our last name with jr?
       
      3. in the i-864 should we include hubby’s current job position in the same company, even it it’s different from the i-134 job position he has?

      I have a question. my i485 was denied because of affidavit wasn't done incorrectly. but my son case still pending. should I refile for him or just myself? when I refile should I add him on the new affidavit even though his case still pending? what's the best way to fill out a i864 with a joint sponsor if my spouse doesn't meet the requirements? Is my son case on Hold till I sort my stuff out? or will it be denied? sorry a lot of questions thanks in advance
