When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

1 RepliesHello! I filed in June 2023, and just recently got my 551 stamp in my passport as my extension letter expired. When receiving my stamp however they took my green card .
I was planning on traveling next year but after all of the horror stories I have been reading on this sub, I emailed my lawyer. He basically said do not travel unless it s an emergency.
So do we have the same rights as a permanent resident or don t we? I have always read that no one can take away our status but an immigration judge, so why is traveling risky?

2 RepliesHad an IR1 interview Last month 21 July 2025 but interview experience wasn't good. CO asked many questions with confrontation. Despite having strong Evidence like 5 Years into marriage, Chat logs, Pictures together, My wife multiple visits with long stay, residence country spouse visa under me, CO Tone was unsatisfactory even for the 100 % Correct Answers. though some of his question i told him an estimate years from decade ago for which i spoke to him i don't remember the exact date. at the end of the Interview he given me 221g Blue slip to perform AP. After the interview the same i received the email from embassy to submit proof of money transfers we did to each other which i submitted the same day. Case date changed happened twice (Next day after submitting the documents and 2 week after my interview. Now because of his confrontation and unsatisfactory tone i am in stress that may my nervous answers if it can impact case. At the end i even told him that i am nervous now.

I am a U.S. citizen father of a 2-year-old U.S. citizen son who has a serious lung condition and recurrent infections since birth. He needs medical treatment in the U.S. and must travel as soon as possible.
His Moroccan mother (my wife) is applying for a B2 visa to accompany and care for him during treatment. She has two other children from a previous marriage one is disabled and she will be leaving them in Morocco temporarily, which shows strong ties to return.
I m looking for advice from anyone who has been in a similar situation in Morocco or a comparable country:

How to best request an expedited B2 visa appointment due to urgent medical need? Is there a high chance her visa will be approved since she has no intention to immigrate to the US because she has other kids

Is it possible for me to appear at the U.S. Embassy with my son to explain the urgency before her scheduled interview?
Any experiences, tips, or success stories would be greatly appreciated.

How do we fill out I-864 if sponsor is unemployed and spouse (beneficiary) makes income that will not continue once we move to the US? We are living in Canada and have already submitted I-130.
1. Are spouses' assets able to be used if they are the beneficiary?
2. We already have a joint sponsor set up, but when looking at the form, I am confused about Part 7 specifically. Do I enter the joint sponsors information in Part 6 and then skip Part 7 (Use of assets to supplement)? Part 7 says if your income or total household income meets requirement, then skip this part. I am unable to use my household income though, correct? Based on the requirements for I-864A, we can't use his income due to the fact that it won't continue once he gains PR status.3. In this scenario, is the joint sponsors' income considered my household income for Part 6 and I just skip Part 7 because it's not applicable?
If I can use the household income (Canadian income from beneficiary), then I wouldn't need a joint sponsor.

My question is, he had a previous marriage in Ph and filed for divorce here in US. We have the divorce decree and our marriage certificate. His CENOMAR shows advisory on his previous marriage in Ph. Will this be a problem?
