When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I am submitting an i-130 for my parents. I forgot to mention in the application that my mom has used different names in her official documents. I am going to upload an affidavit like a One and same person affidavit but confused on whether it needs to be an affidavit by my mom, by me or should it be a letter from the civil authority from my home country?

2 RepliesI applied for Naturalization 6/5/2025, biometrics reused. Didn't find out about Json until a month after . When I checked json updatedAt showed 7/7 but event code still FTAO which apparently was added 6/21. Milestone_days_remaining was in the 50s. There was another updatedAt on 8/8 but no new event code, a few days later progress tab changed from 9 to 10 months and Milestone_days_remaining went from 40s to 70s and time u til next Milestone went from 2 months to 3 months . Still no interview notice.. I am trying to figure out if the updates especially on 8/8 with the progress change meant anything.

2 RepliesI entered the U.S. on an F-1 visa for grad school and later applied for EB-5. I have a pending I-485 and received my EB-5 EAD combo card two months ago. I applied for an SSN using the EAD and was told it would take 4 weeks because of the SAVE response. The same day, the SAVE system website showed my case as returned to agency. so apparently is not pending.
It s now been 8 weeks with no updates. SSA told me to wait another 4 weeks for DHS/USCIS, but they have never requested more info or documents. Researching on forums I noticed that my I-94 lists only my first name and last name, but my passport and EAD are assocaited with my first name plus two middle names could this mismatch be the cause?
I ve never used my EAD for work or travel, so my I-94 still shows F-1 status. I urgently need my SSN to renew my driver s license (expiring soon), and my I-20 will expire in about 2 months.
Questions:

Which agency should I contact to move this forward?

Could the name mismatch be blocking my SSN?

Would a lawyer needed to help resolve this faster?

so I m in Canada, my fianc is in texas
I am considering traveling down on a temporary visit get married and then return to Canada and then proceed with the adjustment of status process while being abroad
my question is when can I return and reside in the states while the adjustment of status is processing is it during the I-130 process or after?
and any tips to go about this route for a cr1?

We re feeling a bit overwhelmed about the steps we need to take following our marriage, particularly concerning his immigration status. We want to understand the necessary processes for him to obtain a green card, eventually apply for citizenship, and explore the option for dual citizenship in the future.
