When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 15 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

1 RepliesFolks here were very helpful in navigating how this process worked and in figuring out if it was even possible for my wife and I. We were able to manage it, from start to finish, in just under three weeks. Here was the timeline:
- July 9th: I (US citizen) got a job offer.
- July 10th: I sent the formal request for DCF to the Vienna embassy.
- July 14th: After a bit of back and forth (the offer needed to be on a formal letterhead), the embassy approved the request. We could come in any Tuesday or Thursday (surprisingly, no appointment needed).
- July 22nd: We both (me and my wife) came in for the formal I-130 petition. The consular officer interviewed both of us about our relationship, and they really liked the short booklet we had prepared with pictures/the story of our relationship (HIGHLY recommend you bring this! It won't be formally requested). We were approved immediately. They even asked us when we'd want it by; we asked for mid-August, which they said was no problem.
- Edit: July 28th: Medical examination (forgot to add this). The consulate had a specific doctor she needed to see, who was pretty quick.
- July 29th: My wife's interview, when the I-864 was filed (she had previously, after I-130 was complete, done the DS-260 online). This required some last-minute maneuvering (my parents graciously agreed to I-864A and we hurriedly got everything in order for that). Likewise, we had police reports from any place she had lived over the age of 16 for more. Do NOT wait on these. If you think a job offer might be coming, get them anyway (good to have on hand in case you unexpectedly need them). The countries we needed would have been quick anyway, but some take a very, very long time. There was unfortunately one hiccup (related to my parents' taxes; just did not have the correct form), but they said we could just email it to them. My wife self-translated her birth certificate, which was fine for them.
- July 29th (part two): By a literal random chance, my parents found the correct form an hour after my wife left the consulate. We emailed it to them promptly.
- July 30th: We sent another followup. They responded quickly, saying they'd get back to us soon.
- July 31st: Green card approved! They got back to us, approved the form, and said my wife could come in whenever to get the initial visa thing (the one they print in the passport).
- August 1st: My wife handed in her passport, and shortly after got an email saying to pick it up Monday (August 4th).
Overall the consulate was incredibly friendly, professional, and efficient. If you feel like you're staring down a DCF barrel, stay calm and (if you think DCF may be a feasible possibility in the future), have the key documents ready ahead of time. Likewise, know your addresses DS-260 wants to know everywhere you've lived the last ten years. We did not necessarily and many of the pieces came together seemingly by chance. I have a minor UK conviction for fare evasion that is recorded only in court records not on police databases or the Police National Computer only court record. I m not sure how this might affect my eligibility for ESTA or if I should apply for a B1/B2 visa instead.
The current ESTA criminal question asks if I ve committed an offense involving serious harm to a person, property, or government authority, which I don t believe applies to my case. But I m uncertain if I need to disclose the conviction and how it might impact future U.S. travel especially a k-1
I d really appreciate any advice or experiences from others who ve dealt with minor UK convictions and U.S. entry.

I hope you all doing great. I don t know if this is even the right question to ask. I have quick question about bringing my sibling to US. Can US citizen petition sibling alone without sibling s derivative beneficiaries and is it even legal? How this would impact my sibling s chances of getting visa after a decade or so if I don t petition their kids along? Lastly , what is the best thing to do out of this?

i hope someone can help me with CSPA. i tried using sites with CSPA calculator but they all said different answers. i am 25 yrs old now, f2a category, unmarried and petitioner (mother) is still LPR. it took awhile because NVC moved me to f2b and i am unable to submit documents in CEAC. in 2023, i received an email from NVC that they moved me back to f2a because of CSPA
