When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

My spouse is here on a B2 Visa, it expires Early November. We are married, just got married if that changes anything. He didnt come here with the purpose of marrying but to travel and have fun with friends ( mutual friends of mine thats how we met). So his visa isnt expired, I am a us citizen. What form(s) should we file? What timeline should we look at? Does each form require its own filing fee?

3 RepliesWhen I mean to "vet" a lawyer, I mostly want to try to figure how experienced the lawyer is with INA Section 320 citizenship cases and also just the experience of filing N-600s and responding to RFEs pertaining to them.

To add to the question in the title, I'm also wondering if it is even worthwhile to solict a lawyer for my N-600 filing?
I feel like since I'm a person who hasn't filled out a single immigration form in my entire life that it might make sense. I have done a ton of research on my own over several months, but then again, I feel like nothing beats the experience of a lawyer. Questions I've had previously including questions such as - "should letters have wet signatures and seals / stamps of certification" would be something that a lawyer would just know.
Not to mention, my N-600 application is for my derivation of U.S. Citizenship that happened decades ago, rather than recently. Evidence for things like physical custody is just much more difficult to obtain at this point, and even if someone filing an N-600 this far into the future does have evidence that fulfills the "preponderance of evidence" standard, it might often be from an assortment of evidence that might not be so easy to present in the best way.
But then again, I've heard horror stories of lawyers making mistakes and people having to correct their lawyer's mistakes on their own, and I worry that for N-600 filings, they might just not have as much experience since the number of derived citizens (and even so those who have acquired it at birth to U.S. Citizen parents) are tiny, let alone those who file USCIS Form N-600 and I feel like a lot of lawyers might not have as much experience with N-600 filings.

I need to get my wife to the US asap. I m basically a single parent.
Do I apply for a Tourist Visa then adjust her status or wait years for an Immigration visa?

We received the notification for the initial interview (AOS from K-1). It took a year to receive this appointment. After 6 months of getting married, we decided that my wife and stepdaughter would return to their original country. Not to go into too great of details, if we had known more of the limitations my wife would have, we never would have taken the K-1 visa route. Live and learn. What is the process to cancel this appointment? Should I have informed USCIS that they left the country and to cancel the AOS?

My long distance partner recently renewed their B2 visa, and it's been a few weeks since there has been any updates to her application (a little over 3 weeks so far).
For context - they live in Tijuana, Mexico, they had an appointment on July 7th, 2025 to take a new picture and drop off their application (I'm unsure if this was considered a dropbox appointment). According to the CEAC status page, the case was created on July 9th, 2025 and the case was last updated on July 24th, 2025 and has been in the "Application Received" status since.
They have had a B2 Visa since they were little, and their parents did the application process/renewal for them, however this time they renewed it on their own. They're worried that there could be an issue with the application since it's taking long.
Has anybody experienced a long wait time for these sort of renewals?
