PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I m based in Latvia and had a question that might be relevant for others in Europe as well.
Has anyone here gone through the K-1 visa process while owning or running a company in Latvia?
I m trying to understand:
- Does owning a business abroad impact the K-1 approval in any way?
- What happens to your company when you move to the U.S. on a K-1 visa?
- Are there any tax or legal issues to consider between Latvia and the U.S.?
- Did you keep your business active or close it before moving?
I feel like this situation is quite common in Europe but not often discussed here.

Need an Idea for a Document to Renew Russian Passport

2 RepliesA few years after my wife arrived her Russian passport was expiring. We were able to renew it through the embassy in DC but it took about 6 months. At that time renewals were valid for 5 years. Five years later my wife decided she wanted to go to Russia to renew it because it could be done there in a matter of days. When we were ready to book the trip I noticed that her passport had just recently expired. A call to the embassy informed us she would NOT be allowed to enter Russia on an expired passport. Not only had her international passport expired but also her internal passport.We sent off to the embassy to get her international passport renewed, but they needed additional information and money of course. In short they were never able to renew her passport saying they could not determine that she was a Russian citizen!Since she had her US passport we kind of just gave up on the Russian one. Now her mother is turning 80 and she worries one day soon she may need to travel to Russia, so she is again pursuing the renewal but this time has enlisted the help of someone that does this sort of thing for a fee.Now comes the part we need help with. Of course when we married she took my last name but in our state as in most others there is no written indication of the new last name on the marriage certificate. And of course at naturalization she changed her first name to a less Russian sounding name.What we need is some solid document that shows the new last name after marriage. Of course they can't just accept that it is normal policy based on marriage. They need a document that spells out her new last name. I tried telling my wife it would be so easy to get the Russian passport in her old last name, but her stubborn nature won't accept that. The person we are working with wants us to go to the county courthouse and do another name change in front of the judge to prove the new last name. More paperwork and another $400+ Seems like there should be an easier way, but I don't know.Any ideas?Thanks for your help.
K1 Visa Trying to Get Interview Slot

We have been camping (about once an hour) USVisaScheduling for an interview slot since we have received Packet 4, which was near the end of March. My fiancee even got IP blocked more than two weeks ago for logging in too frequently, and for some reason, that IP still brings up the "Sorry, you have been blocked" page when trying to load up the page, and now both of us, regardless of IP, get the "Sorry, you have been blocked" page AFTER logging in and completeing the security questions. We have no problem, with that exception of that one IP, to log in and complete the security questions, but the "Sorry, you have been blocked" page always shows up afterwards. This issue been persisting for over a week.
For example, after logging in I get the "Sorry, you have been blocked" page. I reload the login page, and I can enter the log in information again to be met with "Sorry, you have been blocked" page again.
I found a loophole by entering a logged in web link, but since I'm not logged in, it gives me a login error and ask me to enter log in information then answers to the security questions. This does not give me the "Sorry, you have been blocked" page. Customer service does not help at all. They seem to have a template answer of, log in to your accounr and check the message we sent you. But there's no message there...
But setting that aside, looking at past timelines for K1 Visa on this site, it seems like everyone applying for K1 Visa in China is able to get their interview time relatively easy (an interview time of about 1 to 2 months after Packet 4). There is even someone else from this site that got an interview time on the same day I started trying to get it. From the little information I found, interview time for June is almost filled out if not already filled out. The reason why I gave the long background is, I wonder if there is potentially any issue with my account. I can't find anyone else with the potentially permanent IP block issue nor the weird "Sorry, you have been blocked" page AFTER logging in issue.
Comments, insights, or am I just worrying about a nonissue?
i693 for adjustment of status with K1 Visa entry

We are in the process of filing/applying for adjustment of status using form i485. During the process, it says we need to complete a partial i693 because a full panel physician medical examination was already done in the home country of my fianc (now husband). The partial i693 has a vaccine worksheet part 10 that needs to be completed and signed in part 7 by a Civil Surgeon. We went to one today to finish this process.
I was under the impression that the Civil Surgeon/their office would sign the paperwork and stamp it then put it in a sealed envelope and hand it to me the same day. But this office is saying that they are going to send it to the State dept to have it officially stamped, sorted and sealed, then mailed back to Civil Surgeon's office and then that is given to us in a sealed envelope. They insist its a 2 week process.
Is this how it works for everyone else too?
