Hi all,

Can anyone tell me if this would be a problem.

I am a US citizen 51 & I am engaged to a Thai woman.

We are about to file a K1 & I wondered.....

Once I start it is there any reason I cannot go & stay in Thailand while

we wait out the process?

I have not seen anything about it & know I can check progress online.

I can also have my son checking mail here at home.

Any problem anyone can foresee about this?

Thanks for any tips.

There is no problem whatsoever with you going to Thailand while you await approval of your I-129F.

As long as you are able to sponsor her or have someone willing to co-sponsor her, you will be fine.

There is no problem. Many who do this will wait until after the petition is approved, in case there are RFE's. If your careful and diligent, there won't be any. If there are, and you need access to papers you didn't take with you to Thailand, you may need to return to deal with it. Otherwise, no problem at all, provided you can still qualify as sponsor while living abroad. Pesky little detail.

Yes there should be no problem with meeting the 125% rule.

I am a general contractor so can make my hours. But I just do not

think I can be apart for that long. I just got back Nov 2nd from another month there & already

I cannot stand it.

LOL... Oh Mike WE COULD ONLY wish that the average approval time at CSC was ONLY 11 days... we would all be very happy little vegemites.. <grin>

No what that particular stat means is that there is an average time from you sending your I-129F to the CSC centre and them "acknowledging" via a NOA-1 (notice of action) that they have "received it"... however with that being said there is a bit of a backlog there at the moment, and those NOA-1s are taking anything from short 11 days up to over a month..

The approval is the NOA-2 which is taking approximately 100-150 days AFTER THE NOA-1.. (it is in between your NOA1 & NOA2) that you might receive RFE's (requests for further evidence).

THEN once the NOA-2 is given, the file gets forwarded to the NVC in New Hampshire.. (which can also take anything from a week to 5/6 weeks) THEN it is processed there, THEN it is forwarded to your fiancee's country consulate where they will process it (LOL) then they will send to your fiancee' a packet of instructions - which they have to fill in and foward back... BEFORE an interview date is set...

as I said at the start an 11 day approval... OH WHAT A BLISS that would be <grin>

Good luck... and just make sure you take your time with filling out your I-129F and add anything extra to it that you "think" they might need to help ensure that you don't get an RFE (check the guides and example forms here at VJ) to give you some extra advice...

hello guyz this is my situation... im a usc and stayed out of the coutry for 2 years. got married and stayed there for a while... i came back in the us 2 months ago and filed the petition for my husband I-130..... im just wondering while my I-130 still pending can i go back to the philippines while my petition is pending? im concern about the domicile...

i called them and talked the officer and ask them if its ok to be out of the country while my petition for my husband is still pending.. and she said its ok as long im domicile in the us....

shes said as long my address is base on us residency would be fine.. and she ask me if my husband is out of the country... and i said yes.... she said its fine as long my husband is out of the country. and she said if they need more of the paper works to be done my relatives will let me know and inform me that i have a mail and need some documents for me...

i live with my sister and all my mails address there... i just renew my license and looking for a job right now.. but planning to go back 2 months from now.. please help i want to go back to the philippines and be with my husband and wait the approval for 1-13o please need an advice fellows.

by the way i didnt work for last 2 years so i dont have a tax return to file =(

I am living temporarily in Thailand while my fiance's case is being processed. So yes, it can be done.

Hello,

I would be more concerned with the financial situation/affidavit of support than the domicile if I were you -- you said you don't have any income tax returns -- how have you been supporting yourself if you haven't worked? Has your husband been taking care of you? You will definitely need to look into having a co-sponsor - but you must look into the Phillippines' policy for sponsors for K-3s, as many consulates' rules regarding this can vary widely. We have filed a K-1 fiance visa, so our case is a little different. I don't know if you can use either your husband's income or assets for a K-3 for the Philippines -- this is what you must look into. There may be many options for your situation, such as working in the US or in the Philippines, or having a valid letter of employment upon return to the US -- but you must start researching this now.

As far as your domecile question, if you pretty much live with your sister, just provide your sister's address as your own. My father has been receiving my mail in the US while I've been in Thailand. You must make sure you put this address on all forms. In my case, I still have an apartment in Los Angeles. I am on the lease and send rent checks from my CA bank account. So my RESIDENCY is in California, and I filed at the CA office.

Yet once the process began, my NOA1 was not forwarded to my dad's home in Ohio with the rest of my forwarded mail -- many times, govt. mail can't be forwarded and is returned to sender. So I had to call USCIS and change my MAILING address to OH. That may be a bit confusing, but it's what they wanted and it worked out. My father notifies me whenever I have a letter, and he's scanned and emailed all my USCIS and NVC documents to me as PDFs, so I always have a copy here in advance -- then he sends the actual letters to me later.

So, there is no problem with using your sister's address as your own. I would also recommend you open a checking account or some type of bank account in the US as well, if you haven't already, and it's a good thing you have a renewed driver's license or ID -- with your sister's address, right? If anyone asks, you can say you live with your sister. The govt also wants to make sure your husband has a place to live when he arrives in the US.

This year, I was in Thailand for 5 months (we filed from here), went back to the US for 2.5 months, then stayed the rest of the time (over 3 months now, and still here). So again, my situation is a little different as I have not been here consistently for 2 years like you have in the Philippines. I also had a work visa and worked here briefly. But I heard of a man whose fiance was from Thailand -- he was asked to provide a co-sponsor before the consulate would approve his visa, as he had lived and worked in Thailand for the past 2 years. He never mentioned a problem with his domecile, but I also don't know his situation in regards to that.

My fiance's interview is coming up very soon, so hopefully we'll be back in the USA asap. I miss my California home!
