Ok I guess I'll have to get married and not tell them about it, hehe. we're planning to get married sometime in january of '07 back home. And as soon as she gets over here we'll just get the marriage certificate. I wanna file the I-129F ahead so I won't have to wait after we're married to file the I-130. We'll see, hopefully I can get my USC soon. Keeping my fingers cross.

EVOLUTION, are you the petitioner? If so, you can not even file for your BF/GF until after you have become a USC.

There is basically one rule you should follow... Don't lie to the USCIS. The lie will eventually be discovered and will carry very dire consequences, especially if that lie was used to fraudently obtain a visa.

How wonderful... You plan to scam the USCIS right after becoming a citizen. I hope you get caught and prosecuted. If your wife gets caught in the lie she may never be allowed to come here.

obviously you guys don't get what I'm saying here.

Let say if I get my usc next month and after I get I'm going to apply the I-129F petitioning for my fiance.

Let say six ten month down the road like I said before, we're planning to get married in jan of next year. By that time the I-129F the case might almost be complete. Here's my question, Do you guys want me and my fiance to wait untile after we get married as of next year then file the I-130? We can't wait untile next year to start out the I-130. That's just too long of a wait. With all do respect I'm not trying to lie about it, just that I don't wanna have to start the whole process all over again when the case of I-129 might be at the stage of completion. That could take longer. If you were in my shoes what would you do? Tell them that you got married halfway through process of near completion? and have to start with a new form of I-130?

What would I do? Well first of all I'd research my LEGAL options, not suggest lying to USCIS about when I got married and risk the legal repercussions and possibly a ban on entering the US for the beneficiary. That is, in all reality, very VERY stupid, as it will eventually be found out and the problems which would arise would be bigger than just a few months' separation.

If you get married in the middle of filing the K-1, you WILL have to start all over again and wait for the K-3. If you lie, you will get caught, and you will have far bigger problems. So what I would do is NOT make any wedding plans until the visa is in hand. I would file for the K-1 when I was eligible and then WAIT....patiently...until it was approved before moving on to the next step and getting married.

Yes, it sucks you can't get married when you want. That's the problem with marrying a non USC and that's what everyone on this board has gone through. Deal with it.

You wont have to file for the I-130 if you use the I-129F. And if your not a USC you cant file at all anyway.

You cant go on "lets say i have it next month". Wait til you become a USC, THEN file the I-129f.

OK.. first things first is to become a USC. After that, this is my advice.

File an I129F immediatly after becoming a USC. Once approved bring her to the US and get married (you need to marry in the US if you want to use a K-1 visa). File for AOS and AP. Once you have AP, travel back to Cambodia and perform a 2nd ceremony there.

When you become a USC, you have to decide whether you want to bring your girlfriend here as a fiancee or as a wife. Each has its own separate route to follow to do it legally.

If you try to scam them and get caught, you can forget about even bringing her here period.

You need to read the GUIDES above a decide which path you want to follow and stick to it.

If you do try to scam, I personally hope you get caught and it comes back to bite you bigtime in the A$$. This is no way to treat someone who you supposidly love. If you have to wait....well join the club like the rest of us.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Ok here's the plan, if all goes well. Every culture has different way of doing things.

January 2007 our plan is to get married in cambodia, Reason: I wanna have a ceremony for her side of the family. Why january? Because I don't have enought vacation hours to go on another trip this year for a one month vacation. So that's why I'm shooting for January of next year.

In the mean time, I'm applying for my citizenship. Let say (IF) I get to be a citizen this year I will file the I-129F asap.

Now when january come, I will be flying back home to get married.

Let's just say that by january our case is already approve. If you were us whould you start from scratch with the I-130 after all that time you just wasted on the I-129F? I wouldn't think so. And beside don't I have to wait atleast two years to get her Green Card? If we have to wait that long I guess there won't be a wedding ceremony back at home then.

The main thing is that I wanna have a wedding for her family and friends over there before she come and reside with me in the state. In a way it's kinda like saying thanx to her parents for letting us be together. So when she gets over here I wanna do one for my parents and my side of the family.

So another thing, If we get the visa in hand. Is it ok to get married over there and bring her here with me and not having to start filing the I-130? I wanna go see her again asap, if I could go again this year I would. So that's why instead of waisting my trip back and fourth we'll just get married on my next trip back. Sorry for the fuzz earlier, it's not my intention to lie. It's just that I don't wanna waist time going through another forms mind as well just kept going with the I-129F process so that way she can be here with me sooner than later. hope this explain it.

If you get married in Cambodia, the I-129F route will not apply to you. The K-1 visa is for people who are getting married IN AMERICA ONLY-you cannot marry anywhere else in the world if you are using a K-1 visa, it is only for people intending to marry in the US.

If you want to have your wedding ceremony in Cambodia, you will need to go the K-3 SPOUSAL visa route, which you will file for AFTER you marry. These are your two options. Either the K-1 visa, on which you must marry IN THE US, or the K-3, which will allow you to marry in Cambodia.

It's all up to where you want to get married. There's no way to marry in Cambodia and just bring your bride home, unfortunately. You could bring her over on the K-1 before your wedding ceremony in Cambodia, have a civil marriage in the US, file for advanced parole, and go and have the ceremony in Cambodia even though you are already legally married, OR you can wait, marry in Cambodia, and file the K-3 spousal visa. That's it. There is no easy way to do this, unfortunately-immigration is tough.

I am sure almost every single person here did not get to marry according to their plans or what their dream was. We all have to follow the visa process and change our plans accordingly. We have all had to wait an obscene amount of time before we could be with our loved ones. There are those here who have had to wait for almost 2 years from the start of the visa process, and there are those who are still waiting.

If you want to get married in Cambodia, then a K-1 is not for you. A K-1 is the visa option for those who intend to marry in the United States.

Don't make any wedding plans until after you figure out your visa options, and then make your wedding plans according to the visa options, not the other way around. That's the reality if we want to marry a non-USC.
