I-130 approved but I-129 not yet??!!?!

I am in the same boat as you guys since last Thu. 130 approved and 129F pending. The fact that most of us had their 129F touched around the date the 130 was approved tells me that the applications are still connected. In other words, USCIS knows that we applied for both petitions and is working on approving the latter.

Thanks for your responses. I did not know you (G&A) were in the same boat as us. Did you get your approvals in the mail, or did you check the USCIS website or email? I ask this because on the website only one petition may show as approved, but in reality both of them can be approved. I remember this happening to another member here, I just can't remember his name. Only one of his petitions was approved online, but then he got both NOA2 in the mail.

Also, I was told that my I-130 and I-129F were connected now, and that my I-129F was pending. My thing is this, why would they hold the I-130 and not sent it no NVC. I've talked to member JAS S, who was in the same situation as we are and he said that his I-130 WAS sent to NVC. I wonder if these are just new procedures.

Holding the I130 is a procedure that they stated they were implementing a while back (June 2006 if memory serves), but they were struggling to get it implemented. Just a little while back, if they didn't connect your petitions before the I130 was approved, both would make it on to NVC. Jas was one of those (and there are several others in the last few months that had the same thing happen). In fact, DivineMercy did have her I130 forwarded to NVC, but she is waiting for the I129F because (again if memory serves) their embassy has a huge difference in the wait times for CR1 vs. K3.

You are (potentially) at the vanguard of a new phenomenon. KingsleysPrincess, Ahmad, G&A may also be in the same position. But they were just approved very late this week, so they may get their NOA2 in the mail next week and see that they got both. In September, just the opposite happened. A VJer who submitted an I!30 in April and then the I129F in August got them linked at the last minute. The I130 was already being adjudicated (since it appeared to be alone and hence a CR1), so when they got the I129F, they approved it at the same time even the I129F was filed just 3 weeks prior to approval.

I, too, received approval of my I-130, but, so far, no word on the I-129F. I filed them together in September. The I-130 was approved at the VSC on 11/14.

Visa Approved May 21st, 2008.

Where can we find updated Jame's shortcuts procedures? Are these safe to use? How much time can we save by using them?

Please help.

James' shortcuts are meant to be able to reduce the time at NVC by a few months (because you can pro-actively create some of the forms they will send you and send them back before you even receive the forms from the NVC).

Check out this post: http://www.visajourney.com/forums/index.php?showtopic=117 It includes James shortcuts plus cutting out time if you don't feel confident to use James' route :)

James' shortcut is very helpful. It will save you few weeks, not few months while you work with NVC process.

KevFabi, I did use shortcut at NVC process. Please contact me, if you need help with shortcut.

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I responded to that and waited a few weeks for them to process that. Now I was told the other week that the I129f is going under additional security checks and would be 6+ months at that.

I now understand the reason that they don't forward the I130 to the NVC, is that when you file the I129f, your telling them that you want the K-3 visa and not the CR-1 visa. Thus being said they automatically hold it for when you adjust status here in the US when you arrive. This is why it says what is says on top of the NOA2 for the I130. I told the politician working on my case to tell CSC that I now intend for the CR-1 so that they forward it to the NVC. It is obvious that a December or even January interview is totally out of the questions now with a K-3. But I guess, if I do actually get the I130 forwarded over to the NVC, maybe March or April isn't to bad I guess. At least that is better then sitting around on the I129f for another 6 months as, I would be looking at maybe July or August next year.

I am so glad the LIFE act is working like a charm on all our cases....... :protest: :protest:

BTW my case is taking so long I replaced the cool little countdown links twice already, I give up on that now.

Just an fyi for today...sometimes we got so frustrated with the waiting time and excuses for why they havent sent out anything.....so typing a letter via email to my Representative here in Florida made me feel somewhat better. The problem is that I did advise him that I would be calling his office after December 1, 2007 if i had not heard anything, such as my money order being cashed, NOA 1 etc. I know most of you will say be patient and wait. I can agree to this sometimes, however I do not want to end up in that boat going upriver and saying OH WOW, its been four months ...and where oh where has my file gone.

I filed an I-129F first in July 2007 thinking I could wait until we could get married here in the states. Then I didn't want to wait anymore so I went back to Morocco and got married at the end of October. I sent the I-130 packet last week. Does anyone know if I just screwed myself over?

And if I decide to go by I-130...I have to cancel the I-129??? oh my god...i'm been waiting forever for this...i was poreparing myself to another maximum 2 months of wating with I-129 nopt 3, 4 or maybe 6 with I-130....and my hubby was planning to came here to wait with me till the interview...now what?? now he need to stay there...wiating till they decide to send us any form to be filed and payed...oh my god ...I'm losing myself on this...I left my house since february...and I can stay anymore here...its too much for me ...

Well, I think you did. You filed an Fiance visa in July, and now you are telling us you got married and just filed an I-130? If you had waited, your I-129F should have been approved anytime soon and she would have gotten here with the fiance visa. Now you cant pursue the K-1, because you are now married. You just started from scratch and probably have to wait for over a year if you pursue the CR1 visa. You can still file the K-3, and get her here a little sooner. It all depends on the visa you want to pursue and how long you are willing to wait.

Does anyone have EXPERIENCE with my situation? I appreciate your comments YGandMAT. I filed things in the order as they happened. I didn't file a I-129F KNOWING I would be married later. That is just how things went. It felt right to get married in October. And since our status changed from Fiance to married, I needed to let USCIS know that. It would be worse if I just left it with the I-129f and went to interviews under false pretences. So, does anyone else out there have my same situation?

I filed an I-129F first in July 2007 thinking I could wait until we could get married here in the states. Then I didn't want to wait anymore so I went back to Morocco and got married at the end of October. I sent the I-130 packet last week. Does anyone know if I just screwed myself over?

Hello to all, as u all can see on my timeline my I-130 is approved but my I-129 not yet..What can I do. I see that the I-130 is taking forever to be finished...I dont beleive after all this time ...I see some timelines with more then 3 months and still with NVC...they did not complete yet the case to transfer to the consulate...What can I do on this case...should I wait for the I-129??? or continue on the I-130...

You guys think they may approve by now my I-129...

I only have touchs on my I-129 ...never on my I-130...i was surprise when we got the approval only for the I-130...

And if I decide to go by I-130...I have to cancel the I-129??? oh my god...i'm been waiting forever for this...i was poreparing myself to another maximum 2 months of wating with I-129 nopt 3, 4 or maybe 6 with I-130....and my hubby was planning to came here to wait with me till the interview...now what?? now he need to stay there...wiating till they decide to send us any form to be filed and payed...oh my god ...I'm losing myself on this...I left my house since february...and I can stay anymore here...its too much for me ...

Plz God just help me to have the right decision.

Well, I think you did. You filed an Fiance visa in July, and now you are telling us you got married and just filed an I-130? If you had waited, your I-129F should have been approved anytime soon and she would have gotten here with the fiance visa. Now you cant pursue the K-1, because you are now married. You just started from scratch and probably have to wait for over a year if you pursue the CR1 visa. You can still file the K-3, and get her here a little sooner. It all depends on the visa you want to pursue and how long you are willing to wait.

Yes Lena -- you will have to cancel your current I-129F fiance petition with USCIS, and start all over again with an I-130 petition for spouse. This will mean an additional wait, and yes it could be close to a year.

Yet another thing to track! Interesting. I would like to nominate DivineMercy... er add DivineMercy. Kathryn has had her I130 approved for a couple of months and is still waiting for her I129F. Only difference is she is at VSC, but she is in the same general boat.

I am in the same boat as you guys since last Thu. 130 approved and 129F pending. The fact that most of us had their 129F touched around the date the 130 was approved tells me that the applications are still connected. In other words, USCIS knows that we applied for both petitions and is working on approving the latter.
