I-130 approved but I-129 not yet??!!?!

Hello to all, as u all can see on my timeline my I-130 is approved but my I-129 not yet..What can I do. I see that the I-130 is taking forever to be finished...I dont beleive after all this time ...I see some timelines with more then 3 months and still with NVC...they did not complete yet the case to transfer to the consulate...What can I do on this case...should I wait for the I-129??? or continue on the I-130...

You guys think they may approve by now my I-129...

I only have touchs on my I-129 ...never on my I-130...i was surprise when we got the approval only for the I-130...

And if I decide to go by I-130...I have to cancel the I-129??? oh my god...i'm been waiting forever for this...i was poreparing myself to another maximum 2 months of wating with I-129 nopt 3, 4 or maybe 6 with I-130....and my hubby was planning to came here to wait with me till the interview...now what?? now he need to stay there...wiating till they decide to send us any form to be filed and payed...oh my god ...I'm losing myself on this...I left my house since february...and I can stay anymore here...its too much for me ...

Plz God just help me to have the right decision.

ALHAMDULILLAH!!!!

Hi,

Since we have had reports lately that the online system is not being updated lately, you might get the NOA2 in the mail soon for the I129F. Perhaps you should call to see if that is approved too.

You don't need to cancel the I129F. You can let it hang out there, and if it is approved in the next month or two or even three, it will probably beat the I130 case to the consulate. Be aware that now that your I130 is no longer pending, if you do not get the I129F approved real soon, they will cancel it for you. This happened to VJer Neenuh. You must have a pending I130 to have an I129F adjudicated.

It will take 3-6 months for the I130 to finish at NVC. You can speed things up by a few months using James' shortcuts (look in the CR1/IR1 forum). Your husband in the US will receive the bills only if you designate him as your agent. Otherwise, it will be sent to you the beneficiary. It is probably better to have the NVC mail it to a US address though.

What I don't understand is how you were able to send 129F without a copy of NOA 1 for 130. Based on your time like you got your NOA 1 in August, but sent out 129F in June. Right? Aren't you suppose to wait for NOA 1 (130), then make a copy of it, and send it with your 129F package? Probably what has happened is: your 130 petition was approved (that is right), however, your 129F will be never approved (because you are filing for K3 visa, and in order to do so, you MUST, provide copy of you 130 NOA 1). I might be wrong... In fact, lets hope that I am wrong... But that is what I understood from the process...

Not sure about this since our lawyer filed all paperwork at the same time in the case one gets approved before the other - shoot I think - we are married so they just sent all of the it the I129 I130/K3 so again what I have heard from the lawyers recently is that they just send all the guts at once. Please forgive me if I misunderstood but dont think so.

The same thing happened to me. I am also very confused. We had our hopes up high, thinking our petitions would be approved together. Since the USCIS website is not updated, I called USCIS to check the status of my I-129F and they said it was still pending. They were not able to tell me when it would be approved. I really hope they are approved soon. They said they were not approved together because they were sent 2 months apart....(Which is the same in your case).

Also, on a side note. Just to prove how ignorant and the lack of information the USCIS agents have let me tell you what happened to me. I called Friday, 11/02 to check the status of both of our cases....and this is what they told me. Your I-130 is being reviewed and it may be approved from 7 to 14 days. And they told me my I-129F would be approved from 30 to 60 days. My point is this...I got my I-130 NOA2 in the mail on Monday, November 5th, and the notice date on the approval was OCTOBER 30TH!!!! The rep. did not even know my petition had been approved when I called her Friday 11/02. And this really makes me wonder and doubt what these people tell you.

Anyways, I am hoping for the best know. Best of luck to you. And keep us updated on your progress, I will do the same.

Response: Just wanted to clarify things -- the I-129f states to send "evidence" that you filed the I-130. It does not specifically state that this evidence has to be the NOA1 from the I-130. If you don't believe this, it has worked for 3-4 of us now and I provided this advice to others and their applications have been approved. Not that it matters much to you since you have already received your NOA1 for both applications, however, this is not correct.

For those of you who are interested in how I, along with 3 other people were able to do it, look under the thread that says something like "Filing the I-129f without receipt notice from I-130."

The USCIS received your petitions so far apart in time that they were never connected. There's nothing you can do to speed up your I-129F but you can use James' shortcuts for your I-130, unless you really want or need the K3.

Facts are cheap...knowing how to use them is precious...

Please help.

James' shortcuts are meant to be able to reduce the time at NVC by a few months (because you can pro-actively create some of the forms they will send you and send them back before you even receive the forms from the NVC).

Standard procedures, as I understood it, were: first you send 130, then wait for NOA1, then send 129F with copy of NOA1. I am sure I read that in lots of places online. But anyways, I am clueless in this whole process because USCIS works in mysterious ways.

I try to follow USCIS's instruction, but from the experience their instruction is just junk, real and valid instruction can be found only on forums like VJ. :) Thank you guys for sharing your knowledge...

Not wrong, Andreydy. The procedure was first deviated from when the CSC had printing issues (in April) which stopped them from sending out NOA1s for many many months. A few of us (including myself) got copies of our cashed cheques and submitted the I129F with a copy of the cheque as proof (USCIS write the petition number on the back). The procedure again changed when people became confused about which fee to include with their forms so, again, decided to send them together to alleviate any queries.

I'm not sure whether USCIS has ever officially stated that this is acceptable (anyone able to provide a link?), however, many people on this forum have submitted them together and received both NOA1s without any issue :)

Where can we find updated Jame's shortcuts procedures? Are these safe to use? How much time can we save by using them?

Please help.

James' shortcuts are meant to be able to reduce the time at NVC by a few months (because you can pro-actively create some of the forms they will send you and send them back before you even receive the forms from the NVC).

Hello to all, as u all can see on my timeline my I-130 is approved but my I-129 not yet..What can I do. I see that the I-130 is taking forever to be finished...I dont beleive after all this time ...I see some timelines with more then 3 months and still with NVC...they did not complete yet the case to transfer to the consulate...What can I do on this case...should I wait for the I-129??? or continue on the I-130...

You guys think they may approve by now my I-129...

I only have touchs on my I-129 ...never on my I-130...i was surprise when we got the approval only for the I-130...

And if I decide to go by I-130...I have to cancel the I-129??? oh my god...i'm been waiting forever for this...i was poreparing myself to another maximum 2 months of wating with I-129 nopt 3, 4 or maybe 6 with I-130....and my hubby was planning to came here to wait with me till the interview...now what?? now he need to stay there...wiating till they decide to send us any form to be filed and payed...oh my god ...I'm losing myself on this...I left my house since february...and I can stay anymore here...its too much for me ...

Plz God just help me to have the right decision.

The USCIS received your petitions so far apart in time that they were never connected. There's nothing you can do to speed up your I-129F but you can use James' shortcuts for your I-130, unless you really want or need the K3.

I checked with NVC to see if they had received my petition and they don't have it yet. I called USCIS and was able to get connected to CSC and they told me they were holding it pending 129F approval. This doesn't seem right...I thought that once my I-130 was approved that it would be sent to NVC. Apparently USCIS is currently approving I-129F's from June and I sent my I-129F in July. I don't know if this is true or not? Why are they still holding my approved petition?? ANYONE??

The fact that most of us had their 129F touched around the date the 130 was approved tells me that the applications are still connected. Yet another thing to track! Interesting. I would like to nominate DivineMercy... er add DivineMercy. Kathryn has had her I130 approved for a couple of months and is still waiting for her I129F. Only difference is she is at VSC, but she is in the same general boat.
