I know divorce questions have been asked a thousand times, but after reading pages and pages I thought I'd post my specific question.

I am contemplating divorce with my husband (has greencard). No reason to go into specifics, but I'm pretty sure he would want to go back to his country, as he has no ties here (no job after being here for a year, no friends, etc. he basically sits and chats with his friends and family all day while I work)

Would it be easier for him to just fly back and file for divorce on the grounds of abandonment?

The only sticky part is we have a child together, but I'm pretty sure we could come to a mutual agreement regarding that, without the need of a lawyer.

Thanks for any advice. I want to give us more time before I decide, to work things out and see if he adjusts more, but I want to see what my options are now.

Get a divorce here before he leaves. You guys may agree but the state also has to agree regarding children. You should talk to a family lawyer.

Sorry to hear about your situation. I think it would be wiser to get the divorce here in the USA. What are the divorce rules and child custody laws in Morroco? Somehow I don't think child custody would be favorable to you in Morroco if he files that you abandoned the marriage.

If you guys are able to agree on the terms of the divorce and child custody, you should do the divorce here, and before he leaves. When he's in Morocco you'll end up having to send stuff back & forth to sign, he may be unreachable, start new life... and the process will take much longer. Do it while he's still here, it will save you time & money in legal fees.

Is there any particular reason he isn't working after being here a year, considering he has his green card?

If it's not working out for whatever reason, get the divorce before you send him home. Sorry you are going through this.

You should first ask him directly if he wants to go back to Morocco. You sounded like you are making decistions for him. Remember that you agreed to marry him knowing he was from a different culture. If you said you loved him you should encourage him to find a job and support him, if he really refuses then make a other decisition with him. It is so selfish to have control over a person's actions.
