Getting married during the process of a k1

Timeline

I have a little question, my fiancee and I decided to get married eitherway, so we're thinking about going through with the k1 process because it seems to be a faster solution, and our wedding will most probably be with in two-three months. whats going to happen if we do it? by the time the k1 visa is out, we no longer going to be engaged but married.

is it recommended to go this way? or should we wait until we get married and then file for k3 and go on with the other process.

19.03.2008 - I-130 Check Cashed.

21.03.2008 - I-130 NOA-1 Recieved In Mail.

13.06.2008 - I-130 Approved.

24.06.2008 - NVC Case No. Assigned.

01.07.2008 - NVC AOS Bill Generated.

30.07.2008 - NVC Case Complete.

21.10.2008 - Interview.

23.10.2008 - Visa.

29.10.2008 - US Entry.

You can't get married while the K1 process is ongoing. It will make the visa void. You must decide to either do K1 and wait for the visa or marry and then apply for the K3.

I wouldn't waste your money starting the K1 and then get married.

Do some research and decide what way works best for you and your fiance!!!

Good luck either way!!

BTW I went the K1 route and am awaiting my AOS....and waiting and waiting.....

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

You will be abandoning the K-1, and starting over, this time by filing an I-130 after marriage for a CR-1 visa, and perhaps if you want to spend more $$ file I-129F to start the K-3 process.

The K-1 does not convert to a K-3 if you marry during the processing of the K-1, they are two very different visas and process.

This question has to be one of the most frequently asked on visajourney. There should be pinned thread about it.

You can have a non-legal ceremony before using a K-1, but a K-1 is a fiance(e) visa, not a spouse visa, and if anyone along the way (USCIS, Consulate, POE official) even smells a wedding, you could be in for a world of hurt.

It is much easier to prove you ARE married than to prove that you aren't.

We had a religious ceremony in my (then) fiance's country before I knew better, and I worried about it the whole way through. I would recommend against it.

Non-legal refers to the laws of the country of the non-USC.

Have a nice engagement party, but save the wedding for the US... that's my $.02

The K-1 visa is a fiance(e) visa.

If you get married during the K-1 process you are now husband and wife.

You will have to start over with a spousal visa and abandon the K-1 thereby wasting time and money.

If you are wanting to get married soon just wait, get married and then file for the spousal visa.

08.01.2011 - I-751 SENT

08.05.2011 - Check cashed

08.08.2011- NOA Received

08.19.2011 - Biometrics Letter Received

09.12.2011 - Biometrics Appointment

01.27.2012 - Card production ordered

02.01.2012 - 10 year GC Received

07.25.2021 - N400 filed online

08.09.2021- Biometrics re-use notice

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN

Moved to the U.S. to be with my baby on July 19th, 2008 on a K1 visa!!!!

June 28th 2007 sent 1-129f to NSC

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

If your wedding is scheduled in 2-3 months you should wait and file K3 or CR1. No way any K1 will process in 3 months. more like 10 months.
