URGENT HELP! Will I be allowed to stay in usa, if us citizen played a game and wants to go out of marriage???

I am in a horrible situation. I married only 9 month ago, gave up everything in switzerland for my husband. Everything was fine, until we where married and had daily routine. He chanced completly, and since 5 weeks doesnt talk to me anymore at all. he transfered all the payrolls to his own account. I work only temporary and have to use this money now for food and gas and my child. He is out most of the off days with his ex wife again. He treats me like a peace of dirt now. I loved this guy with all my heart. My lawyer told me to ask for divorce so he must pay me alimony. I am still in his house. I cant go back to switzerland, I have nothing there anymore. I want to stay here. My permanent card expires in february 2009. First I dont even know if its a conditional resident card or not. All what is written is permanent resident card, expires after 2 years. Is this a conditional resident card? Can i remove conditions if i will be divorced by then? Will i be able to stay in usa or will they send me back? Even if my husband was the one who cheated and treated me like this? Please, please, advice, I am so worried and dont know what to do... I would think that you would be able to stay and to lift conditions by yourself. You entered the marriage in good faith! I believe your husband still has support issues and I would suggest you contact an attorney. Most cities have a legal aid society that can help you. I am sorry for your situation and hope you can find a solution. Good luck :thumbs:

I am so sorry to hear about that! It is horrible, that he treat you like that, I think he should think at what you left for him, for a new life. I don't know his age, but acting like that sounds just so childish! Are you from the german side or french side? I wish i could help in a way. Try to talk to him, try to convince him to move away from NC, and maybe your couple will get a new chance. If you are divorced before you get your GC, then you maybe get an immigration lawyer, but I know, that cost alot, and I still hoping things will get ok soon for you. Try to talk to him, and make him understand it is not only you it is your child also, he have not to play with your and your child feelings!

What a heartbreaking story! Jasman is right, that you entered the marriage in good faith would be the backbone of your case to stay in the U.S. if you get divorced within two years of your marriage date. Have a look at this link under the heading Who Is Eligible? USCIS removing conditions page

If it's clear that your relationship is beyond repair, I'd start building your case now. Gather as much proof/documentation as you can to prove what your husband is doing--transferring payrolls, withholding money from you, spending a lot of time with his ex, etc.

Good luck! You deserve someone a whole lot better than that!

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Due to the short nature of the marriage there maybe support issues, but I highly doubt you will be awarded alimony but of course this varies from state to state....

Sorry to hear that! First of all, since your current permanent resident card expires after 2 years, I think it's a conditional resident card. Did you enter US with K1 visa? If you did, that should be a conditional resident card. According to the instruction on the USCIS website, even you get divorced, you can still apply to remove conditions by yourself. But you would better find an attorney to help you. Good Luck!

Thank you so much for all your help and advice! I try to survive this horrible time as good I can together with my daughter. I never ever thought this could happen to me. I loved this guy more then everything else. He turned to be a icecold, carless guy, and just told me, oh well, he is no more in love with me.. after 8 month! I found out he is dating again his ex and all his kids are happy. He stoped all payrolls of our shared account and want me to dry off. I got not much part time work for now and hope the lawyer make him to pay enough. In top i will go on to sue his ex for alianation of affection. The worst is, when he is home, only when he has to work, he doesnt talk a single word with me anymore not even with my little daughter. Its a bad situationi as well for her. He is military and police trained to play mental torture and he is good in it. I guess the most important thing now is to go to court as soon as possible to come out of this situation. he hoped I will just leave the country and go back home, but I cant, I gave up everything there.. so i have to fight for my rights here...

You need to consult with a family lawyer to verify the divorce laws in your district. I see from your profile that you are in North Carolina. You should also note that NC law is specific on the one year separation requirement prior to divorce...so if you plan to do so, you'll need to move quickly to get the clock ticking on that one year. You might wish to ask the lawyer if you could claim divorce from "bed and board" if you are in North Carolina. This is available to spouses who can demonstrate fault on the part of the other spouse. If granted, he would have to move out. And alimony should be sought in the initial petition. There's no adding it later.

Please try to gather and save as much paperwork as you can to show that your marriage was entered into in good faith. These could be joint bills, old statements of your joint account (if any), joint lease, insurance, pictures, mail, etc.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Document, Document, Document EVERYTHING..

Here are some suggestions how.

First make copies of his payroll transfers to new accounts.

2nd if he is hanging out @ his x wife's, call the police to the location and make them file a report.

If he gets rude with you at all, call the police every time and make them file a report.

get it on paper, everything he does.

and if he gets violent, make sure you call the police and put his BUTT in jail.

as for support.

He signed the AOS, He is required to support you for many years to come, it is a fully binding agreement regaurdless of which state you live in.

It is cases like this that made USCIS require the AOS to begin with.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

My neighbor works with the Int'l students at Wake Forest Univ here in Winston-Salem. He was the one who helped me with all the beginning paperwork. Both he and my dog's orthopedic surgeon have recommended Heather MacKenzie's firm, but it's here in W-S. Their number is 336.722.9944 You won't necessarily see Heather, she has a several other atty's that work on cases as well.

I'm local, so if you need some support or to get out of the house, let me know.
