I am thinking on whether I apply an EAD or not based from my situation. You see, I got here through a K1 visa and my hubby and I are planning on applying for AOS soon. We have a baby. She is just 5 months old and my husband doesnt want me to work until she gets to preschool, w/c will be 3+ yrs from now. My husband just wants me to dedicate my time to our baby and be a housewife basically.

Since I won't be working till on a later time, I don't necessarily need to apply for an EAD right? Or is this mandatory regardless? And if I do get my green card, and maybe by that time I would be ready to work, I can go and do so w/o an EAD right?

Please explain somebody? :help:

It doesn't sounds like you have any use for an EAD right now. It is not mandatory. When you get your green card, you will no longer need an EAD in order to work.

No, EAD is not mandatory, it is only required if you want to work before you get your GC.

You will be able to work and travel freely after your AOS is approved.

Good luck with the new baby.

It is not required that you get an EAD as by the time you are ready to work you should have your greencard. In many states however it is one of the forms of ID that you can use to get your drivers license before you have your greencard. Requirements for getting a drivers license vary by state so if you do not have a drivers license and want one, you may want to look into what is considered acceptable identification.

6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

twellspeak is right - you only need the EAD if you are having a hard time getting a Driver's license and want it! We didn't apply for EAD or AP (saved the money) because my wife is learning English and will be a long while before she is ready to work. Also many countries Drivers Licenses are valid for 6 months here, so you can drive. Good Luck

There's no law that says you HAVE to get the EAD... however I did because it was a legal ID that would be accepted by the banks, the DMV etc. and it let me open a joint bank account with my husband. I never used it for work but at least I had the security of knowing that I had a legal ID in my purse for the extra seven months it took to get my GC.

Save the money for the EAD and do something for the baby. It doesn't seem you will have any use for one anyway. Enjoy spending time with your child. They grow up too fast anyway.
