I just called NVC...they've got my stuff now :thumbs: What a relief to finally know that my paperwork is out of CSC's hands!!!! 21 days between NOA2 and NVC receipt for me...sounds about the norm these days

Hi everybody. 30 days since our approval and NVC has not received the petition :crying: :crying: :crying: This is awful. My husband call NVC and CSC every day and nothing. Our plans to be together in September are broken again. Our child will turn a year soon and it is raised without a father because of USCIS and lazy people of CSC. Nobody will give us back this time. We lose so much. I am very upset. Animals in USA are treated better than us.

Wow, that was a quick change. Going from an endless wait to an interview 4 days from now. It sure didn't take the embassy that long once they got it. Congrats!! and good luck :thumbs:

Jas, your I129F can still be approved, and you still have the option of pursuing the K3 if it is. The only thing is, if the NVC processing is finished and the approved I130 case gets to the consulate/embassy, your I129F will be cancelled. But then, you will be ready to get a CR1 interview anyway, so it might not matter much. The only thing is, if you start paying the NVC bills, then get the I129F approved and go that route, you will lose that money.

Are there other people in the same boat as me? By that I mean, you have your I130 approved but not your I129. My case is with NVC. Do you know how it will affect not having a I129 approved going into this? Thanks

I think I'm laughing only at the irony. I will be stuck there too. It's like a horror story. Just when you think you killed him -- HE'S BACK... and we thought waiting for the K-3 was tough... isn't the AOS even worse?

Anyway, enjoy getting your loved one here. I think the AOS will be easier to deal with once we have our spouses at our sides.

Even though I've heard it's really tedious, I'm not too worried about the AOS. I don't even have a clue what we need to do for AOS right now because, like probably most other VJer's, I'm just excited as heck to get my sweetheart here. I'm an organization freak, so once it comes time to do the AOS I'm sure it won't be a problem.

You're exactly right about everything being easier when our spouses are with us. Once she's here and we can do everything together, the AOS will probably seem like no big deal at all.

I just got off the phone with NVC. They said that they mailed out a letter to my lawyer requesting the affidavit of support and visa bill information that my lawyer has to fill out and send back. They also said after they receive that info. then they will review things and send to the Embassy. What is going on? Why does my process seem completly different then all of yours. In your case it's going directly to the Embassy...

Jas,

Affidavit of support is sent to NVC for a CR1. You will end up completing an I864 instead of I134. Further, there is the immigrant visa fee that you must pay for a CR1 to NVC. Go to the guides and look up the CR1/IR1 process for the details of that. Everyone else in this thread got I129F approvals too, so they are doing the K3. There is little for the NVC to do for the K3. The non-immigrant visa fee is collected at the embassy/consulate. They forward those quickly. You are headed in to the CR1 process. If you don't want a CR1, don't pay the bills, and you have to tell the NVC you are waiting for the K3, that you want the I130 sent back to USCIS to hold for the eventual AOS.

The difference in wait times for CR1 vs K3 is the difference in USCIS I130 and I129F petition processing times + NVC doing more for CR1 in more time + difference in interview waits at the consulate. That NVC time is part of why so many still go for K3 even though the difference in USCIS I130 and I129F petition processing times are not as different as they used to be. NVC time with I130 approved only can take 3-4 months.

Thank you for your reply, much appreciated. Everything is always so confusing...and there is always waiting.... :wacko: Why does everything have to take soo long. I came to India thinking, I might be able to go to the embassy and expedite things based on her pregnancy, but I don't know now....I wonder how much longer before the embassy receives the paper work.

Any particular reason why most people got their I129 approved also and not me? :huh:

well when it comes to uscis.. nothing is usual or normal. they are very unpredictable. mine took over 4 weeks to get transfered from csc and there were other people who got the approval after me transfered within 14 days. so give uscis a call through RFE and asking what the heck is happening. .

It should be any day now. It seems like it's been taking between 3-4 weeks on average lately. It will definitely get there though...just part of the big waiting/patience game when it comes to CSC.
