I filed under 3 year rule but have been married since June 2021. My I-751 is still pending as of February of 2024.

3 year rule

yes within 90 day early filing window

I wouldn't file on the first day of eligibility.

Also, on 10/25 would you be married for 3+ years living together in marital union or under 3 years?

90 day early filing window applies to requirement for being LPR for 3 years but not requirement to be married for 3 years.

I’ve been married for over 4 years. The website shows I’m eligible to file on 10/25

Marital union is a big one. You must be living with US citizen spouse in marital union for over 3 years at time of filing N-400. Yes, you were married for 4 years, but did you live separately at any point in the last 3 years due to you being overseas and spouse being in the US? Some officers interpret marital union very strictly, denying such cases if filed within 90 day early filing window. If you file at 3 year anniversary of living in the US, that usually gives no chance to deny your case on this requirement.

I should be fine then, we’ve been together. Never separated or lived apart. We’re blessed with two kids as well

So no moment when you were overseas and spouse was in the US?

 

Just making sure. I was asked this question even though I applied under 5 year rule.

question about that: you are talking about times apart that lasted more than 6 months or so? I left the U.S. to see my family for a week and my spouse stayed here in the U.S. That's not what you mean, correct?
