Hi everyone,

 

I’m hoping I can get some insight to this.

 

Friend of mine has a Brazilian passport and applied for a tourist visa from Brazil, but was denied, lack of ties to the country.

 

Since then he is also gotten citizenship in the EU through Portugal.

 

 When he went to register online for his ESTA it said it was denied. 
 

not sure what happened. I always thought as an EU passport holder you could come to the United States.

 

He has no prior history in the United States no criminal record fully employed in Brazil.

 

Does anybody have any suggestions on what happened or what could be done.

 

 Not sure if we should hire a lawyer?

What could a lawyer do? Not sure if if the esta denied could be overcome

Wasted Time and money.  ESTA was denied, likely, due to the denied B2.  B2 visas are entirely at the discretion of the consulate officer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No, there's no right to enter the US if you're an EU passport holder. They are eligible to apply for ESTA, but it won't necessarily be granted. As part of the application they'll have asked if he had ever been refused a visa for the US, so assuming he answered that truthfully and said yes (if he didn't, then that's a whole other issue!), then that's probably why it was refused. 

 

He can reapply, but I'd leave it at least a year before trying again.

Having a B refused does not make you ineligible, why he was refused ESTA may or may not be linked to the B refusal

Ohh he could apply for a B
