Hello there ,

I hope you all doing great. I don’t know if this is even the right question to ask. I have quick question about bringing my sibling to US. Can US citizen petition sibling alone without sibling’s derivative beneficiaries and is it even legal? How this would impact my sibling’s chances of getting visa after a decade or so if I don’t petition their kids along? Lastly , what is the best thing to do out of this?
Your help regarding this matterwould be greatly appreciated. God bless you all!

I assume you are a USC thinking about an F4.  If a correct assumption you file an I130 for your sibling listing all their immediate relatives.  Derivatives, if still eligible after the wait for the F4, will also get a visa (i.e. minor children, or children that did not age out, and spouse).

Visa Received : 2014-04-04 (K1 - see timeline for details)

Your sibling wouldn’t get a visa ‘after a decade or so’, it would be triple that. So there’s a good chance any derivative children would age out by then anyway.

Yes I am a US citizen. My question is still there. Could I apply for my sibling alone or I should file petition for all their family including sibling’s spouse and children etc. ?

Well by default you can only petition for someone you have a relationship with - your sibling. The fact that F4 also allows her family members (spouse, children under 21) doesn't mean you're petitioning them - they're derivatives of her petition.

You will only file one I130 for your sibling.

Got to admit, asking about a mother/father seemingly wanting to leave their children by choice isn’t something that sits comfortably with me. But you only ever apply for your sibling alone. In 25-30+ years when s/he becomes eligible for a visa is when dependents are relevant. If s/he is divorced and wants to leave her children then s/he can apply for just their own visa then, if any children haven’t aged out anyway.
